கற்பழிப்பு ஒரு சாதாரணமான தவறா – தருண் தேஜ்பாலுக்கு வக்காலத்து வாங்கும் பெண்–நண்பர்கள்!

2014-15 நிகழ்வுகள் – தருண் தேஜ்பால் வழக்கு நிலவரம்: பாலியல் வழக்கில் கைதான ‘தெஹல்கா’ நிறுவனரும் முன்னாள் ஆசிரியருமான தருண் தேஜ்பாலை ஜாமீனில் விடுவித்து இந்திய உச்ச நீதிமன்றம் ஜூலை.1, 2014 அன்று உத்தரவிட்டது. கடந்த 2013 ஆண்டு நவம்பரில், கோவா மாநிலம் பனாஜியில் உள்ள நட்சத்திர ஹோட்டல் ஒன்றில் தெஹல்கா சார்பில் நடைபெற்ற நிகழ்ச்சியில், ஹோட்டல் லிப்ட்டில், தேஜ்பால் தன்னை பலாத்காரம் செய்ததாக அவருக்கு கீழ் பணியாற்றிய பெண் நிருபர் புகார் அளித்தார். தேஜ்பாலின் முன் ஜாமீன் மனு நிராகரிக்கப்பட்டதை தொடர்ந்து, அவர் கோவா போலீஸாரால் கடந்த நவம்பர் 30-ம் தேதி 2013 கைது செய்யப்பட்டு சிறையில் அடைக்கப்பட்டார். பிப்ரவரி 2014ல் இவர் மீது குற்றப்பத்திரிக்கை தாக்கல் செய்யப்பட்டது. இந்நிலையில், அவரது தாய் கடந்த மே 18-ம் தேதி 2014 மரணமடைந்ததால் அவருக்கு உச்ச நீதிமன்றம் மூன்று வாரம் இடைக்கால ஜாமீன் வழங்கியது. ஜாமீன் கிடைத்தும் தாயின் இறுதிச் சடங்கில் கலந்து கொள்ள முடியாததால், இதர நிகழ்ச்சிகளில் கலந்துகொள்ள வசதியாக ஜூன் 27-ம் தேதி 2014 வரை தருண் தேஜ்பால் இடைக்கால ஜாமீன் நீட்டிக்கப்பட்டது.

தருண் தேஜ்பால் சார்பில் கபில் சிபல் ஆஜராகி வாதிட்டது, 2015: அந்நிலையில், அவருக்கு 01-07-2014 அன்று சாதாரண ஜாமீன் வழங்கி உச்ச நீதிமன்றம் உத்தரவிட்டுள்ளது. இருப்பினும், அவருக்கு கடுமையான நிபந்தனைகளை உச்ச நீதிமன்றம் விதித்துள்ளது. நிபந்தனைகளை கடைபிடிக்க தவறினால் மீண்டும் கைது செய்யப்படுவார் எனவும் எச்சரித்துள்ளது. இந்த வழக்கு தொடர்பான ஆவணங்களைத் தனக்கு அரசுத் தரப்பு வழங்காததால் விசாரணைக்குத் தடை விதிக்குமாறு கோரி உச்ச நீதிமன்றத்தில் தேஜ்பால் மனு தாக்கல் செய்தார். இந்த மனு, தலைமை நீதிபதி எச்.எல்.தத்து, நீதிபதி ஏ.கே.சிக்ரி ஆகியோர் அடங்கிய அமர்வு முன் 6-01-2015 வெள்ளிக்கிழமை அன்று விசாரணைக்கு வந்தது[1]. தருண் தேஜ்பால் சார்பில் மூத்த வழக்குரைஞர் கபில் சிபல் ஆஜராகி வாதிட்டார். இதையடுத்து, தேஜ்பாலுக்கு எதிரான வழக்கை கோவா நீதிமன்றம் விசாரிப்பதற்கு மூன்று வார இடைக்காலத் தடை விதித்து நீதிபதிகள் உத்தரவிட்டனர். அவருக்கு வழக்கு தொடர்பான ஆவணங்களை வழங்குமாறு அரசுத் தரப்புக்கு உத்தரவிட்டனர்[2].

2016 ஜூனில் திசைத்திரும்பிய விவகாரம்: தாராளமான எண்ணங்கள் கொண்ட மனத்தினரால், தருண் தேஜ்பால் பற்றிய விவகாரத்தை மறுசிந்தனையுடன், தீர்மானிக்க முடியுமா என்று, மாளவிகா சங்வி[3] [Malavika Sangghv] என்ற எழுத்தாளர் மிட்-டே என்ற இதழில் குறிப்பிட்டது சர்ச்சைக்குள்ளாகியிருக்கிறது[4].

Time for a RE-THINK? Has the time come to reassess our response to the Tarun Tejpal THINK brouhaha now that the need for strong liberal voices is called for? In retrospect, the relentless media campaign that shredded the once darling of the intelligentsia could be regarded as excessive.	மறுசிந்தனைக்குரிய நேரம்? தருண் தேஜ்பால் பற்றிய விவகாரத்தை மறுபரிசீலினை செய்ய தாராளமான சிந்தனைகாரர்களுக்கு நேரம் வந்து விட்டதா? அறிவுஜீவிகளின் விருப்பம் மிகுந்த நாயகனாக இருந்தவனின் மீது ஊடகங்களின் தாக்குதல் அதிகமாகவே இருந்தது என்பதனை பார்க்கமுடிகிறது.
No doubt Tejpal had committed a grave error. One that pricked the bubble of his public image and gave his detractors ammunition to demolish him, but was there really need for such a vociferous dragging through the coals? This line of thinking has been finding more and more takers especially now when regressive thoughts and actions seem to rule.	சந்தேகமில்லாமல் தருண் தேஜ்பால் மிகப்பெரிய தப்பை செய்துள்ளார். அது அவரது பொது மக்களிடம் இருந்த நல்ல மதிப்பைக் கெடுத்ததுடன், அவரின் எதிரிகள் அவரைத் தாக்கவும் ஏதுவாக இருந்தது. பிற்போக்கு சிந்தனைகள் மற்றும் நடவடிக்கைகள் ஆட்சி செய்யும் இந்நேரத்தில், இப்பொழுது இந்த கருத்தை ஆதரிப்பவர்கள் இருக்கிறார்கள் எனலாம்.
A discredited Tejpal, though out on bail, after all is not in any condition to fight the good fight. However, as predicted by this column, the rehabilitation of the once celebrated writer is underway: word comes in that his high-profile festival for the country’s intelligentsia will resume as early as next year. If this is true we won’t be surprised. After all, everyone makes a comeback in India. தருண் தேஜ்பாலால் கற்பழிக்கப் பட்ட பெண், இதனை கடுமையாக சாடியுள்ளார்[5]: ஆனால், தருண் தேஜ்பாலால் கற்பழிக்கப் பட்ட பெண், இதனை கடுமையாக சாடியுள்ளார்[6]. “முற்போக்கு அரசியலின் சிறப்பு ஆணாதிக்கம், செக்ஸ்–வன்முறை மற்றும் செக்ஸ்–கொடுமை முதலியவற்றை எதித்து போராடுவதில் வெளிப்படுகிறது. ஆனால், எல்லாமே மன்னிக்கப்படவேண்டும் என்று தாராளமான எண்ணங்கள் கொண்டவர்கள் கூறுவது உழுவதுமாக அபத்தமானது ஆகும். தெஹல்காவைப் பொறுத்த வரையில் தாராளமானது என்றெல்லாம் ஒன்றுமேயில்லை. தெஹல்காவின் ஆரம்பம், அதற்குக் கிடைக்கும் நிதி அதன் ஆசிரியரின் நண்பவர்களுக்கு எதிராக, ஏதாவது செய்திகள் இருந்தால், அவற்றிற்கு எப்படி அவரது செய்தி அறையிலேயே சமாதி கட்டப் படும் என்பதெல்லாம் அந்த தாராளமான எண்ணங்களில் வெளியானது தெரிந்ததே. தெஹல்கா உண்மையிலேயே யோக்கியமானதாகவும், நியாயமானதுமாக இருந்திருந்தால், அதற்கு எப்படி தில்லி, மும்பை, கோவா, நைனிடால் போன்ற இடங்களில் எல்லாம் பெரிய அள்விற்கு சொத்துகள் சேர்ந்திருக்கும்? ஊடக வழக்காடு மன்றத்திலேயே தருண் தேஜ்பால் பாதிக்கப்பட்டிருந்தால், எப்படி அவர் வழக்கறிஞர்களுக்கு வாரி பணத்தைக் கொடுத்துக் கொண்டிருக்கிறார்? முடிவாக இந்த வேகமாக செயல்படும் நீதிமன்றம் யாருக்கு பலன் அளிக்கப் போகிறது? பணம் மற்றும் அதிகாரம் கொண்ட குற்றவாளிகள், பத்திரிக்கையாளர்கள், அரசியல்வாதிகள் மற்றும் தொழிலதிபர்கள் முதலியோருடன் சேர்ந்து கொண்டு “தாராள மனம் கொண்டத் தன்மை” என்ற போர்வையில் அனைத்துலக மாநாட்டை நடத்தினால், எவ்விதமான நீதி கிடைக்கப் போகிறது?” என்று விளாசியுள்ளார்[7]. தருண் தேஜ்பாலாலுக்கு வாதாடும் வழக்கறிஞர் கபில் சிபல், அதாவது, காங்கிரஸ் கட்சி தலைவர், முன்னால் சட்ட அமைச்சர்……..அப்படியென்றால், அவர் எவ்வளவு பீஸ் வாங்குவார் என்று தீர்மானித்துக் கொள்ளலாம். ஆக, நீதிமன்றத்தில், இவ்வழக்கு விசாரணை வரவில்லை என்றும் சீரியஸாக-தமாஷாகக் கூறுகிறார்கள்[8]. இருப்பினும் அவருக்கு வக்காலத்து வாங்க ஊடகத்தினர் கிளம்பியிருப்பது விசித்திரமாக இருக்கிறது[9]. இதனால், சமூக வலைதளத்திலும் கருத்துகள் வந்துகொண்டிருக்கின்றன[10]. கற்பழிப்புக்கு உட்பட்ட பெண்ணின் நிலைமை மறந்து, இவ்வாறெல்லாம் பேசுகிறார்களே என்று எடுத்துக் காட்டப்படுகிறது[11].

காங்கிரஸ், செக்ஸ், பாரம்பரியம்: ஆரம்பத்திலிருந்தே காங்கிரசுக்கும் செக்ஸுக்கும் தேவையில்லாத தொடர்புகள் இருந்து தான் வந்தன. நேரு மாமா அதில் அதிகமாக மாட்டிக் கொண்டுள்ளார்.  காங்கிரஸ்காரர்கள் இதில் ஏன் அதிகமாக மாட்டிக் கொள்கிறார்கள் என்று  2009லேயே அலசப்பட்டது[1].  பதவி, பணம், வசதி முதலியவையெல்லாம் இருந்தால், ராஜா மட்டுமல்ல, இக்கால அரசியல்வாதிகளும், ஜாஜபோகம் அனுபவிக்க ஆசைப்படத்தான் செய்வார்கள். 2004-2014 பத்தாண்டு சோனியா ஆட்சி ஊழல் ஆட்சிக்கு மட்டுமல்ல, செக்ஸ் ஊழலுக்கும் பெயர் போனது, பலருக்குத் தெரியாது. ஏப்ரல் 2012ல் சோனியா விசுவாசியான அபிஷேக்சிங்வியின் செக்ஸ் வீடியோ வெளிவந்தது[2].

கேரள காங்கிரஸ்காரகளின் செக்ஸ் லீலைகள் எல்லைகளைக் கடந்தன: சோனியா காங்கிரஸ் செக்யூலரிஸம் பேசினாலும், கேரளாவில் கம்யூனலிஸம் தான், அது முஸ்லிம் கட்சி, கிருத்துவக்கட்சி எதுவானாலும் சரி. கிருத்துவக்கட்சியின் தலைவர் பி.சி.ஜார்ஜ் சாதாரணமாக அசிங்கமாக, ஆபாசமாக, பாலியல் பாஷைப் பேசிவருபவர்[4] என்று பல செய்திகள் வந்தன[5]. வயலார் ரவி என்ற அமைச்சரும் இதில் சளைத்தர் அல்ல[6]. இதற்கான வீடியோ ஆதாரங்கள் “யூ டியூப்”பில் உள்ளன. கேரள அரசியல்வாதிகள் செக்ஸ் விஷயத்தில் மாட்டிக்கொள்வதும் சகஜமானதுதான்[7]. “ஐஸ்கிரீம் பார்லர் செக்ஸ்” என்ற வழக்கு மிகவும் பிரசித்தம்[8], ஏனெனில், இதில் பல கேரள புள்ளிகள் சிக்கினர். டிசம்பர் 11, 2011ல்கூட, பி.கே. குன்னாஜக்குட்டி என்ற IUML அமைச்சர் போலீஸாரால் விசாரிக்கப் பட்டுள்ளார்[9]. இப்பொழுது 2013ல், அச்சுதானந்தன், “ஐஸ்கிரீம் பார்லர் செக்ஸ்” விஷத்தைப் பற்றிய ஒரு டைரி கிடைத்துள்ளது என்றும், அதில் குட்டி எவ்வாறு சம்பந்தப்பட்டுள்ளார் என்ற ஆதாரங்கள் உள்ளதாக கூறியுள்ளார்[10]. ஆகஸ்ட் 2013ல் ராகுலுக்கு திருமணம் ஆயிற்றா, இல்லையா என்றெல்லாம் செய்திகள்வந்தன[11]. வழக்கம்போல பெண்களுடன் தொடர்பு என்று செய்திகளும், புகைப்படங்களும் வெளிவந்தன[12]. நவம்பர் 2013ல் பீதாம்பர் குரூப் ஸ்வேதாமேனனிடம் மாட்டிக் கொண்டார்[13].

ஜனவரி 2014ல் சசி தரூர் விவகாரம், அவரது மணவாழ்க்கை மீறிய பந்தங்களை எடுத்துக் காட்டியது. அவர் மறுத்தாலும், மனைவி சுனந்தா புஷ்கரே எடுத்துக் காட்டி, பொறுக்கமுடியாமல் “தற்கொலை” செய்து கொண்டாள்[14].மார்ச் 20914ல் கேரள உமன் சாண்டியின் சூரிவொளி மின்சாரம் ஊழலும் பற்பல செக்ஸ் தொடர்புகளை எடுத்துக் காட்டின[15]. இனி சமீபத்தைய திவாரியின் செக்ஸுக்கு வருவோம்.

நீதிமன்றம் மூலம் மாட்டிக் கொண்ட என்.டி. திவாரி (ஏப்ரல் 2014): காங்கிரஸ் கட்சியின் மூத்ததலைவரும், ஆந்திர முன்னாள் கவர்னருமான என்.டி. திவாரி தான் தன் தந்தை என்று ரோகித்சேகர் (வயது 34) என்பவர் கடந்த 2008ம் ஆண்டு பரபரப்பான குற்றச்சாட்டை கூறினார்[16]. தனது தாயாரான உஜ்வலா மற்றும் திவாரிக்கும் பிறந்த மகன் என்று குறிப்பிட்டார் மகன். ஆனால், உஜ்வாலாவுக்கும் தனக்கும் எந்த தொடர்பும் கிடையாது என்றும், ரோகித் தனது மகன் இல்லை என்றும் பல ஆண்டுகளாக திவாரி கூறிவந்தார். இதையடுத்து, தன்னை திவாரியின் மகன் என்று அறிவிக்கக் கோரி டெல்லி உயர்நீதி மன்றத்தில் ரோகித் 2007ஆம் ஆண்டு வழக்கு தொடர்ந்தார்[17]. இது தொடர்பான வழக்கை விசாரித்த நீதிமன்றம்,  என்.டி.திவாரியிடம் மரபணுசோதனை நடத்த உத்தரவிட்டது.  இதற்கும் திவாரி முதலில் மறுத்தார், பிறகு “சேம்பில்” எடுக்கப்பட்டது. மரபணுசோதனையில் ரோகித் சேகருக்கு தந்தை திவாரி தான் என தெரிய வந்தது[18]. வழக்கை விசாரித்த நீதிமன்றம், திவாரி தான் ரோஹித் சேகரின் தந்தை என்று கடந்த மாதம்  22ஆம் தேதி தீர்ப்பளித்தது. இந்த பரிசோதனை முடிவை ஏற்க மறுத்த திவாரி,  தன் மீது அவதூறாக பழிபோடுவதாக ரோகித் சேகரை குற்றம் சாட்டினார்.  பின்னர் வழக்கு தொடுத்த ரோகித் சேகருடன் கோர்ட்டுக்கு வெளியே சமரசம் செய்து கொள்ள விரும்பினார்.  6 வருட சட்ட போராட்டத்திற்குப் பிறகு ரோகித் சேகரை தன் மகனாக ஏற்றுக் கொண்டதையடுத்து உறவுப் பிரச்சினை முடிவுக்கு வந்தது[19].

திருமணம் செய்து கொண்ட திவாரி (மே 2014): உத்தரபிரதேசத்தில் 3 முறை முதல்வராக இருந்தவர் என்.டி. திவாரி.  ஜார்கண்ட் மாநில முதல்வராகவும் ஒருமுறை இருந்துள்ளார். காங்கிரஸ் கட்சியின் விசுவாசமான தலைவர்.  2007 – 2009ம் ஆண்டுகளில் ஆந்திர மாநில ஆளுநராக இருந்தபோது,  இளம்பெண்களுடன் நிர்வாணமாக இருந்த வீடியோ காட்சிகள் வெளியானதால் பதவியை ராஜினாமா செய்ய வேண்டிய கட்டாயம் ஏற்பட்டது. அவருக்கு வயது 89.  இவருக்கும் உஜ்வாலா சர்மா என்ற பெண்ணுக்கும் இளமைகாலத்தில் இருந்த நெருங்கிய உறவுகாரணமாக, . ரோகித் சேகர் என்ற மகன் பிறந்தார்[20].  89 வயதான திவாரி,  லக்னெள நகரில் உள்ள தனது இல்லத்தில் உஜ்வலாவை புதன்கிழமை (14-05-2014) திருமணம் செய்துகொண்டார்[21]. 88வது வயதில் திவாரி இரண்டாவது திருமணம் செய்துள்ளார் என்பது குறிப்பிடத் தக்கது[22].

மகிழ்ச்சியில் உஜ்வலா– மனைவி: இந்நிலையில், திவாரியின் வீடு முன்பாக இம்மாத தொடக்கத்தில் போராட்டத்தில் ஈடுபட்ட உஜ்வலா, பின்னர் வீட்டுக்குள் அனுமதிக்கப் பட்டார். அதன் பிறகு,  அந்த வீட்டிலேயே தங்கியிருந்த உஜ்வலாவுக்கும் திவாரிக்கும் புதன்கிழமை திருமணம் நடைபெற்றது.  “எங்கள் உறவுக்கு சமூக அந்தஸ்து கொடுக்க அவர் விரும்பினார். அதனால், என்னை திருமணம் செய்துகொண்டார். இதனால், நான் மகிழ்ச்சியாக இருக்கிறேன்.  சட்ட நடைமுறைகளை முடித்த பின்னர் அனைவரையும் அழைப்போம்”  என்று நிருபர்களிடம் தெரிவித்தார் சர்மா.திருமணம் குறித்து செய்தியாளர்களிடம் வியாழக்கிழமை (15-05-2014) உஜ்வலா கூறுகையில்,  “பாரம்பரிய முறைப்படி எங்கள் திருமணம் நடைபெற்றது.  எங்கள் உறவுக்கு சமூகமதிப்பு கொடுக்க வேண்டும் என்று திவாரி விரும்பினார். இன்னும் சில சட்ட நடைமுறைகள் உள்ளன.  அவை முடிந்த பிறகு அனைவரையும் விருந்துக்கு அழைப்போம்’  என்றார்.

டெல்லியைச் சேர்ந்த தெகல்கா செய்தி நிறுவன தலைவர் தருண் தேஜ்பால் மீது, அங்கு பணியாற்றும் பெண் நிருபர் பாலியல் புகார் செய்தார். கடந்த மாதம் நவம்பர் 7-8, 2013 தேதிகளில் கோவாவில் தெஹெல்கா இதழ் நிகழ்ச்சி ஒன்று நட்சத்திர விடுதியில் நடந்தது. அப்போது, விடுதியில் இருந்த லிஃப்டுக்குள் தேஜ்பால் பெண் நிருபரிடம் பாலியல் அத்துமீறலில் ஈடுபட்டார் என்பது அவர் மீதான புகார். இதையடுத்து தருண் தேஜ்பால் மீது கோவா போலீசார் பாலியல் பலாத்காரம், மானபங்கம் ஆகிய பிரிவுகளில் வழக்குப்பதிவு செய்து, கைது செய்து நீதிமன்றத்தில் நிறுத்தினர்.  பின்னர் அவர், 6 நாள் போலீஸ் காவலில் ஒப்படைக்கப்பட்டு விசாரணையை சந்தித்து வருகிறார். அவர் இரண்டு முறை மருத்துவ பரிசோதனைக்கு உட்படுத்தப்பட்டுள்ளார். துணை மாவட்ட கண்காணிப்பு போலீஸ் அதிகாரி தலைமையில் நடைபெற்று வரும் இந்த விசாரணை முழுமையாக பதிவு செய்யப்பட்டு வருகிறது.  இனி இவ்வார நிகழ்வுகளைப் பார்ப்போம்.

02-12-2013 (திங்கட்கிழமை): தருண் தேஜ்பால் கோவா மருத்துவமனைக்கு அழைத்துச் செல்லப்பட்டு, ஆண்வீரிய பரிசோதனைக்கு உட்படுத்தப் பட்டார். வீரியத்தன்மை உள்ளது என்று சோதனை முடிவில் உறுதியானது. மதியம், கோவா மனோதத்துவம் மற்றும் மனித குணாதசியவியல் மருத்துவமனைக்கு அழைத்துச் செல்லப்பட்டு, பரீட்சைக்கு உட்படுத்தப் பட்டார்.

03-12-2013 (செவ்வாய் கிழமை): மறுபடியும் ஆண்மை பரிசோதனை செய்யப்பட்டது. தேஜ்பால் தனக்கு செல்போன், மின்விசிறி எல்லாம் வேண்டும் என்று கேட்க ஆரம்பித்தார். ஆனால், உணவு, உடை மட்டும் குடும்பத்தாரிடமிருந்து அவருக்கு அனுப்ப அனுமதி கொடுக்கப்பட்டது. கோவாவில் இவர்களுக்கு பங்களா உள்ளது என்று முன்னமே குறிப்பிடப்பட்டது.

04-12-2013 (புதன்கிழமை): ஏற்கனவே 2 முறை மருத்துவப் பரிசோதனைக்கு உட்படுத்தப்பட்ட தேஜ்பாலுக்கு இன்று 3-வது முறையாக மருத்துவப் பரிசோதனை நடைபெறுகிறது.   முன்னர் தன்னுடைய லாக்கப் ரூமில் மின்விசிறி பொறுத்தப்படவேண்டும் என்ற தருண் தேஜ்பாலின் கோரிக்கையை இவர் நிராகரித்தார்[1]. இதுகுறித்து கோவா முதல் மந்திரி மனோகர் பாரிக்கர் இன்று டெல்லியில் நிருபர்களிடம் கூறியதாவது[2]: “தருண் தேஜ்பால் மீதான வழக்கு விரைவு நீதிமன்றத்திற்கு மாற்றப்படும். உச்ச நீதிமன்ற அறிவுறுத்தல்படி இந்த வழக்கானது பெண் நீதிபதி தலைமையில் விசாரிக்கப்படும்.  பாதிக்கப்பட்ட பெண்ணுக்கு விரைவில் நீதி கிடைக்கும். தேஜ்பால் தனது செல்வாக்கை வைத்து எந்த தவறான நடவடிக்கைகளிலும் ஈடுபடக்கூடும் என்று யாரும் கவலைப்பட தேவையில்லை. தேஜ்பாலின் முந்தைய நடவடிக்கையை கருத்தில் கொண்டு, அவர் மோசமாகவோ அல்லது வித்தியாசமான முறையிலோ நடத்தப்படுவார் என்று யாரும் கவலைப்படத் தேவையில்லை ”, இவ்வாறு அவர் கூறினார்[3]. பாரதிய ஜனதாவின் முன்னாள் தலைவராக பங்காரு லக்‌ஷ்மணன் இருந்தபோது, பாதுகாப்பு தொடர்பான ஒப்பந்தத்திற்காக வெளிப்படையாக பணம் வாங்கும் காட்சிகளை மறைமுகமாக பதிவு செய்து வெளியிட்டு, முன்பு தருண் தேஜ்பால் ஹீரோவாக வலம் வந்தவர் என்பது குறிப்பிடத்தக்கது[4].

05-12-2013 (வியாழக்கிழமை): குற்றஞ்சாட்டிய பெண்ணின் மூன்று ஊடக நண்பர்கள் கோவா வந்தடைந்தனர். இவர்கள் தெஹல்காவில் வேலைப் பார்ப்பவர்கள். தேஜ்பாலின் மீது செக்ஸ் / கற்பழிப்பு முயற்சி விசயம் குறித்து முதல் பகுதி பதிவை இங்கே பார்க்கவும்[5]. பாதிக்கப்பட்ட பெண்ணின் இ-மெயில் கொடுக்கப்பட்டுள்ள விவகாரங்களைத் தெரிந்து கொள்ள இங்கே படிக்கவும்[6]. சோமா தொடர்ந்து தேஜ்பாலை மறைத்து, ஆதரித்து வருவது பற்றிய விவரங்களை இங்கே படிக்கவும்[7]. எப்.ஐ.ஆர் போடப்பட்டவுடன், சோமாவின் நிலைமாறியது, தேஜ்பால் தன்னை மாட்டப்பார்க்கிறார்கள் என்று கூறியது பற்றிய விவரங்களை இங்கே படிக்கவும்[8]. சோமாவிடமும் விசாரணை நடந்தது[9]. அரசியல் சம்பந்தப்பட்டுள்ள விவரங்களை இங்கே படிக்கவும்[10]. திங்கட்கிழமை, 30-11-2013 அன்று ஒருவழியாக கைது செய்யப்பட்டார்[11].

06-12-2013 (வெள்ளிக்கிழமை): தான் கற்பழிக்கப்பட்டதாக குற்றஞ்சாட்டிய பெண்ணின் மூன்று ஊடக நண்பர்கள் பனாஜியில் மேஜிஸ்ட்ரேட் – க்ஷமா ஜோஷி [Judicial Magistrate First Class Kshama Joshi ] முன்பாக தனித்தனியாக 11 மணியளவில் ஆஜராகினர். அவர்களிடமிருந்து தன்னிலை விளக்க பிரமாணங்கள் [statements] எழுதி வாங்கிக் கொள்ளப்பட்டன. சனிக்கிழமை சோமா சௌத்ரி வந்து  ஆஜராவார்[12].

‘பரஸ்பரம்சம்மதத்துடன்தான்நடந்தது[13]: தருண்தேஜ்பால்‘-போலீஸிடம்வாக்குமூலம்: இதனிடையே போலீஸ் காவலில் இருக்கும் தேஜ்பாலிடம், காவல்துறை துணை கண்காணிப்பாளர் சம்மி டவரஸ் முன்னிலையில் விசாரணை அதிகாரி சுனிதா சவந்த் தலைமையிலான குழுவினர் வாக்குமூலத்தைப் பதிவு செய்தனர். அப்போது, பெண் நிருபரை தாம் பாலியல் பலாத்காரம் செய்யவில்லை என்றும், அவரது சம்மதத்துடனே அனைத்தும் நடைபெற்றதென்றும் தேஜ்பால் தெரிவித்துள்ளார். அதாவது, இத்தனை நாகரிகம் மிக்கவர், மெத்தப் படித்தவர், அரசியல் ஆதரவு பெற்றவர், ஒரு மிருகத்தைப் போல லிப்டில் செக்ஸ் செய்வார் என்றால் ஆச்சரியமாக இருக்கிறது. பெண் நிருபர் மற்றும் தெஹல்கா முன்னாள் நிர்வாக ஆசிரியர் ஷோமா சௌத்ரி ஆகியோருக்கு தாம் மின்னஞ்சல்கள் அனுப்பியதையும் தேஜ்பால் போலீஸிடம் ஒப்புக்கொண்டுள்ளார்[14]. ஆனால், தேஜ்பால் வாக்குமூலம் குறித்து அவரது வழக்குரைஞரை தொடர்பு கொண்டு கேட்டபோது, அதற்கு பதில் அளிக்க அவர் மறுத்து விட்டார். இவ்விவகாரம் தொடர்பாக தேஜ்பாலின் மகளிடம் கோவா போலீசார் விசாரணை நடத்தியுள்ளனர்[15]. தருண் தேஜ்பால் மகள் தியாவிடம் டோனா பவ்லா அருகே 2 மணிநேரம் விசாரணை நடத்தப்பட்டதாக தெரிகிறது. பாதிக்கப்பட்ட பெண் தேஜ்பால் குறித்து அவரது மகளுக்கு தகவல்கள் கொடுத்துள்ளார். பாதிக்கப்பட்ட பெண்ணின் குற்றச்சாட்டுகளை உறுதி படுத்த அவரிடம் விசாரணை நடத்தப்பட்டதாகவும் தெரிவிக்கப்பட்டுள்ளது.ஊடக ஒத்துழைப்புகள் – பாலியல் தொல்லைகளுக்கா, கற்பழிப்பிற்கா?: சையத் நக்வி[16] “இதெல்லாம் முக்கோண சகஜமான விசயங்களாக உருவெடுத்து வருகின்றன. தருணின் மனைவி மற்றும் மகள் மிக்க மனப்போராட்டங்களில், பாதிப்பில் இருப்பர். பதிக்கப்பட்டப் பெண்ணோ, என்ன தன்னுடைய “பாய் பிரென்ட்” இப்படி செய்து விட்டானே என்று நினைக்கலாம். மனிதக்கதையின் உண்மை இத்தகைய எல்லைகளில் தான் கட்டுப்படுகின்றன”, என்று 07-12-2013 அன்று எழுதுகின்றார்[17].  என்னத்தான் கதையளந்தாலும், தான் ஒரு முஸ்லிம் என்பதைக் காட்டிக் கொள்ள, “தருண், ஊடகங்கள் ரேப்பின் மீதுதான் கவனம் செல்லுத்துகின்றன, ஆனால், அவை முசபர்நகர் மீதும் கவனத்தைத் திருப்ப வேண்டும்” [I messaged Tarun: A media so focused on rape, should be directed to Muzaffarnagar[18]]. முசபர்நகர் பிரச்சினையே முஸ்லிம் இளைஞர்கள், ஒரு இந்து பெண்ணை பாலியல் ரீதியில் தொடர்ந்து தொல்லை செய்து வந்து, அவளது சகோதரன் தட்டிக் கேல்கச் சென்றதால் தானே, பிறகு கலவரமாக மாறியது. இது பெரிய மனிதர்களின் செக்ஸ் விளையாட்டுகள் என்பதால், சில ஊடகங்கள் மறைமுகமாக வக்காலத்து வாங்குகின்றன[19].

30-11-2013 காலை 10 மணிக்கு கோவாவிற்கு குடும்பம் சகிதம் வந்து அதிரடியாக வீரநடை போட்டு வலம் வந்தார் தருண் தேஜ்பால்.

தேஜ்பாலின் வழக்கறிஞர் கீதா லூத்ரா [Geeta Luthra] வாதங்களை அரசு தரப்பு வக்கீல் லோட்லிகர் [public prosecutor Lotlikar] மறுத்து ஆதாரங்களை வைத்து வாதிட்டனர்[1].

கைது செய்யப்பட்ட சில நிமிடங்களில் தேஜ்பாலின் சகோதரர் மின்டி கிரைம் பேஞ்சிற்கு வெளியே மயங்கி விழுந்தாராம்[4].

தேஜ்பால் குடும்பம் அவர் கைது செய்யப்பட்டால் தங்களது குடும்ப மானமே போய்விடும் என்று கூட வாதிட்டார்களாம்[5]. அதற்கு, “உங்களது அவர் கைது செய்யப்பட்டால் தங்களது குடும்ப மானமே போய்விடும் என்ற வாதம் செல்லுபடியாகாது, ஏனெனில் அது ஏற்கெனவே வெளியில் வந்து விட்டது. அதனால், அவர் கைது செய்யப்படுவதால் மேலும் எந்தவித பாதிப்பையும் ஏற்படுத்தாது”, என்று விளக்கம் அளிக்கப்பட்டதாம்!

23-11-2013 (வெள்ளிக்கிழமை): இரவு தஹல்கா ஆள் ஒருவர் கற்பழிப்புப் புகார் கொடுத்த பெண்ணின் வீட்டிற்கு வந்து சமரசம் பேச முயன்றுள்ளார். முதலில் மிரட்டி, அழுத்தம் கொடுக்க பார்த்துள்ளார். பிறகு, நேரிடையாகவே, “உனக்கு என்ன வேண்டும்”, என்ற ரீதியில் பேச ஆரம்பித்துள்ளார்[1].  தேஜ்பாலின் மீது ஒன்றும் குற்றமில்லை என்றெல்லாம் வேடம் போட்டு வந்த சோமாவிக்குத் தெரியாமல், இந்த மிரட்டல், பேரம் நடந்திருக்காது. இதனால் தான், மற்ற ஊடகக்காரர்கள் தெஹல்காவை கடுமையாக விமர்சிக்கிறார்கள் போலும். சர்ச்சையை ஏற்படுத்தியுள்ள இந்தப் பாலியல் வன்கொடுமைச் சம்பவம், நவம்பர் 5 முதல் 10-ம் தேதி வரை கோவாவின் ஐந்து நட்சத்திர ஓட்டலில், ‘யோசனை விழா’ என்ற பெயரில் தெஹல்கா நடத்திய கூட்டத்தின்போது நடந்ததாக கூறப்படுகிறது. சென்ற திங்கட்கிழமை 18-11-2013 அன்று பாதிக்கப்பட்ட பெண் சோமாவிடம் புகார் கொடுத்தார்[2].

24-11-2013 (சனிக்கிழமை):  பினோ ஜான் [Binoo K. John] என்ற தேஜ்பாலின் நண்பர், இவர் இவ்வாறுதான் நடந்து கொண்டுள்ளார். இவரை எதிர்த்தால், வேலை போகும், கஷ்டப்பட வேண்டியிருக்கும், என்றெல்லாம் எடுத்துக் காட்டியுள்ளார், “கடுமையான இந்த வித்தையில் இவர் மிகவும் வல்லவர், கஷ்டங்களில் எந்த அளவிற்கும் தாழ்ந்து இம்சித்து தனது இச்சைக்கேற்ப வெற்றி காண்பவர், தன்னால் பாதிக்கப்பட்டவர்களை நொந்து, அழவைத்து, துன்புறுத்தி, நிறைய வேளைகளில், வேலைக்கூட இல்லாமல் செய்யும் குணத்தைக் கொண்டவர்”. அதாவது, அந்த அளவிற்குக் கொடுமைக்காரர் என்று தெரிகிறது.

25-11-2013 (திங்கட்கிழமை): போலீசார் அன்று தஹல்காவின் செய்தியாளர்கள் தில்லியிலுள்ள கோவா சதனில் விசாரித்துள்ளார்கள்[3]. கற்பழித்தாக குற்றம் சாட்டிய, தஹல்காவின் பெண் நிருபர் / பத்திரிக்கையாளர் ராஜினாமா கடிதம் கொடுத்தார். இந்தியா டுடே தனது   இணைதளத்தில் அக்கடிதத்தை பிரசுருத்துள்ளது[4]. பொதுவாக பெண்கள் சமூகத்தில் தாங்கள் பிறகு எப்படி நடத்தப்படுவார்கள், உறவினர் என்ன நினைப்பார்கள் என்ற கவலைகளினால் தான் பெரும்பாலும் புகார் அளிக்காமல் இருந்திருக்கிறார்கள்[5].

தேஜ்பாலின் மீதான வழக்கு மிகவும் வலுவான நிலையில் உள்ளது[6]:

The case against accused Editor-in-Chief of Tehelka, Tarun Tejpal, is straightforward and stark: alleged sexual assault and rape — grave cognisable offences punishable under Sections 354A, 354B, 376, and 376(2) of the Indian Penal Code — in addition to the non-cognisable offences specified by the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013. The details of what allegedly happened inside a lift of the Grand Hyatt, Bambolim, Goa on November 7, 2013, the opening night of Tehelka’s Think festival, are chilling in the revulsion they produce. The victim — a young woman journalist employed by Tehelka, who was allegedly lured into, and imprisoned within, the lift, which was then manipulated by the alleged assailant to make it “stay in circuit” — showed both courage and professional precision in setting out the details in her letter of complaint to her Managing Editor and “mentor,” Shoma Chaudhury. She also had the presence of mind immediately to seek solace and solidarity from three of her journalistic colleagues and to unburden herself of what happened. “Confused, hurt and really, really scared” and not wanting to lose her job, she reported for her assigned work the next day and, incredibly, that evening, after the sessions were over, Mr. Tejpal is alleged to have attempted to reprise the sexual harassment and assault after forcing her into the lift. All this plus the harassing and aggravating texts and the emailed “apologies,” one private, the other public, that the alleged assailant and rapist sent her seem to make the criminal case against Mr. Tejpal unassailable.

கைது–தவிர்விப்பு–பெயிலுக்கு  மனுதாக்குதல்  செய்தது  ஏன்?: குற்றமற்றவர், தூய்மையானவர், யோக்கியமானவர் என்றால் தைரியமாக வெளியே வந்து ஊடகத்தாருடன் பேசவில்லை, பேட்டிகள் கொடுக்கவில்லை, மாறாக மறைந்து வாழ்ந்து கொண்டிருக்கிறார் இந்த வீர-தீர-சூர குத்துகின்ற, கொத்துகின்ற, அதிபுத்திசாலியான புலன் விசாரணை பத்திரிக்கையாளர். திங்கட்கிழமை, தருண் தேஜ்பால் தனது வக்கீல் மூலம் தான் கைது செய்யப்படுவோம் என்பதை உணர்ந்து அதனை தவிக்க கைது-தவிர்விப்பு-பெயிலுக்கு மனு தாக்குதல் [ anticipatory bail apprehending arrest] / முன்ஜாமீன் கோரி தில்லி உயர் நீதிமன்றத்தில் செய்துள்ளார்[7].உயர் நீதிமன்ற நீதிபதி ஜி.எஸ். சிஸ்தானி முன்பு, மூத்த வழக்குரைஞர்கள் கே.டி.எஸ். துளசி, கீதா லூத்ரா ஆகியோர் ஆஜராகி, மனுவை உடனே விசாரிக்கும்படி கேட்டுக் கொண்டனர்.அதையடுத்து, மனு மீதான விசாரணை செவ்வாய்க்கிழமை நடைபெறும் என்று அவர்களிடம் நீதிமன்றப் பதிவாளர் அலுவலகம் தெரிவித்தது[8].

பெண்  நிருபர்  உள்பட   நான்கு பேர்  ராஜிநாமா: இந்நிலையில், தருண் தேஜ்பால் மீது பாலியல் தொந்தரவு குற்றம்சாட்டிய பெண் நிருபர் உள்பட அந்நிறுவனத்தில் பணியாற்றிய நான்கு பேர் திங்கள்கிழமை ராஜிநாமா செய்தனர்[9]. இஷான் டங்கா [ Ishan Tankha] என்ற இன்னொரு பாதிக்கப் பட்ட பெண் பத்திரிக்கையாளரும் இதில் அடங்குவர்[10]. குற்றம்சாட்டிய பெண், இம்மூவரிடம் தான் தன்னுடையய நிலைமையைலக் கூறியுள்ளார்[11]. பெண் நிருபருக்கு ஆதரவாக ராஜிநாமா செய்துள்ள பத்திரிகையாளர்கள், “பாலியல் புகாரை தெஹல்கா நிறுவனம் கையாண்ட விதம் அதிருப்தி அளிக்கிறது. அதனால் ராஜிநாமா செய்கிறோம்’ என்று சமூக வலைதளங்கள் மூலம் தெரிவித்துள்ளனர். குற்றம்சாட்டிய பெண், “தஹல்கா பெண்கள், கம்பெனியில் வேலை செய்பவர்கள், பத்திரிக்கையாளர்கள் மற்றும் பெண்ணியப் போராளிகள் அனைவரையும் ஏமாற்ரிவிட்டது, தோற்கடித்துவிட்டது”, என்று சாடியுள்ளார்[12].

தருண் தேஜ்பால்  கைது செய்யப்படாததற்கு மகளிர்  ஆணையம்  கண்டனம்: இதற்கிடையே, தெஹல்கா நிறுவன ஊழியர்கள் மூவரிடம் பெண் நிருபர் கூறிய தகவலைப் பதிவு செய்த கோவா போலீஸார், தருண் தேஜ்பாலிடம் விசாரணை நடத்தாமல் கோவா திரும்பியிருப்பதற்கு தேசிய மகளிர் ஆணையம் கண்டனம் தெரிவித்துள்ளது. மகளிர் ஆணையத்தின் உறுப்பினரும், வழக்குரைஞருமான நிர்மலா சாமந்த் பிரபாவால்கர் செய்தியாளர்களிடம் கூறுகையில், “தேஜ்பால் மீது முதல் தகவல் அறிக்கை பதிவு செய்யப்பட்டுள்ளது. அதன் பிறகும் அவரை கோவா போலீஸார் ஏன் கைது செய்யவில்லை?, அவரிடம் போலீஸார் விசாரணை நடத்தாதது அதிர்ச்சியளிக்கிறது”,‘ என்றார். இந்நிலையில், இந்த விவகாரம் குறித்து கோவா போலீஸ் உயரதிகாரி கூறுகையில், “பாலியல் விவகாரம் தொடர்பாக ஒரு குழு தில்லி சென்று விசாரித்துள்ளது. பெண் நிருபரின் வாக்குமூலத்தைப் பெற மற்றொரு குழு மும்பை செல்லவுள்ளது. அதன் பிறகு தருண் தேஜ்பால் விசாரணைக்கு அழைக்கப்படுவார்’ என்றார்[13].

அரசியல்  ஆக்கப்படும்  கற்பழிப்புப்  புகார்கள்: பின்னணியில் காங்கிரஸ் உள்ளது என்பது அனைவருக்கும் தெரியும். மேலும், தேர்தல் நேரத்தில் இப்படி சொல்லி வைத்தால் போல பாலியல் குற்றச்சாட்டுகள், கற்பழிப்புப் புகார்கள் முதலியவற்றைக் கிளப்பிவிடுவதும் விசித்திரமாக இருக்கிறது. ஏனெனில், திடீரென்று கோடானு-கோடி ஊழல்கள், காங்கிரசீன் கரைப் படிந்த வழக்குகள், கருப்புப் பணம் போன்றவைப் பற்றிய பேச்சுகளை இவ்விசயம் மறைத்து விட்டது. பாதிக்கப்பட்டப் பெண்களின் நிலைப் பற்றி யாரும் விமர்சிக்க முடியாது. ஆனால், இவை அரசியலாக்க, காங்கிரஸ் முயல்கிறது என்று தெரிகிறது. தேசிய மகளிர் ஆணையம் காங்கிரஸின் கைப்பாவையாக வேலை செய்கிறது என்று தெரிகிறது. குற்றம் நடந்த இடம் கோவா எனும்போது, வேண்டுமென்றே கோவா போலீசாரை தில்லிக்கு வரவழைத்தது, அந்நாடகத்தில் வெளிப்படுகிறது. இப்பொழுதே தேசிய மகளிர் ஆணையம் தேஜ்பாலை ஒழுங்காக கோவாவுக்குச் சென்று போலீசாரிடம் ஒத்துழை என்று ஆணையிட்டிருக்கலாமே?

குஜராத்  போன்று  கோவாவிலும்  பிரச்சினை  ஏற்படுத்த முயலும்  போக்கு: கோவாவில் பாஜக ஆட்சி நடப்பதால், அங்கும் குஜராத்தைப் போல போலீசாரை வைத்து குழப்பத்தை ஏற்படுத்த காங்கிரஸ் முயல்வதை அவர்கள் உணர்கிறார்கள் அதனால் தான் ஜாக்கிரதையாகச் செயல் பட்டுக் கொண்டிருக்கின்றனர். தில்லியில் தேஜ்பால் கைது செய்யப்பட்டிருந்தால், அவர் யாதோ பெரிய தியாகி போன்ற நிலையை ஊடகக்காரர்கள் ஏற்படுத்தியிருப்பர். அப்பொழுது, தில்லியில் பாஜக செல்வாக்குக் குறையும். ஏற்கெனவே “ஆம் ஆத்மி கட்சி” இன்னொரு “ஸ்டிங் ஆபரேஷனில்” மாட்டியுள்ளது. இதனால், தான் வீசும் வலையில் சிக்கிக் கொண்டால், காங்கிரஸ் தேர்தலில் லாபம் அடையும் என்றுதான் தேசிய மகளிர் ஆணையத்தை ஆட்டிவைக்கிறது. இதனால் தான் மகளிர் ஆணையத்தின் உறுப்பினரும், வழக்குரைஞருமான நிர்மலா சாமந்த் பிரபாவால்கர் செய்தியாளர்களிடம் கூறுகையில், “தேஜ்பால் மீது முதல் தகவல் அறிக்கை பதிவு செய்யப்பட்டுள்ளது. அதன் பிறகும் அவரை கோவா போலீஸார் ஏன் கைது செய்யவில்லை?, அவரிடம் போலீஸார் விசாரணை நடத்தாதது அதிர்ச்சியளிக்கிறது”,‘ என்றார்.

தொடர்ந்து  மத்திய  உள்துறையின்  தலையீடுகள்: இது தொடர்பாக பனாஜியில் கோவா மாநில டிஜிபி கிஷன் குமார் செய்தியாளர்களிடம் கூறுகையில், டெஹல்கா தலைமை செய்தி ஆசிரியர் தருண் தேஜ்பால் மீது முதல் தகவல் அறிக்கை பதிவு செய்யப்பட்டது. இந்த வழக்கின் விசாரணைக்கு அவர் ஒத்துழைக்காவிட்டால் கைது செய்யப்படுவார் என்று தெளிவாக்கப்பட்டது. இதனால், இந்த விவகாரத்தில் கூடுதல் தகவல்களை பின்னர் தெரிவிக்கிறேன் என்றார். இதனிடையே இந்த விவகாரம் தொடர்பாக உள்துறை அமைச்சகம், கோவா மாநில அரசிடம் அறிக்கை கோரியுள்ளது. இதுவரை அமைதியாக இருந்த உள்துறை இப்பொழுது, திடீரென்று விழித்துக் கொண்டது நோக்கத் தக்கது. நக்கலடித்த மணீஸ் திவாரிதான் கோவா திரைப்பட விழவைத் துவக்கி வைத்து பாஜகாவை சாடிவிட்டு சென்றார் என்பது குறிப்பிடத் தக்கது. ஏனெனில், திடீரென்று இவ்விசயம் அரசியல் ஆக்கப்படுகிற்றது என்று சிலர் குற்றஞ்சாட்டுகின்றனர். மேலும் தருண் தேஜ்பாலிடம் விசாரணை நடத்தி கைது செய்ய டெல்லிக்கு கோவா போலீசார் விரைந்து இருப்பதாகவும் தகவல்கள் தெரிவிக்கின்றன[5].

கோவாவிற்கு விசாரணைக்கு வர ஏன் போலீசார் ஆணையிடவில்லை?: நேரில் ஆஜராகும்படி, ஏன் வாரண்ட் / ஆணை பிறப்பிக்கப் படவில்லை என்று தெரியவில்லை. கோவா ஒன்றும் தெஹல்காக்காரர்களுக்குப் புதிய இடமல்ல. ஜாலியாக வந்து போகும் இடமாகும். பிறகு இவர்கள் எப்படி ஆட்டிப்படைக்கின்றனர் என்று தெரியவில்லை. மேலும் குற்றம் நடந்த இடம், எப்.ஐ.ஆர் போடப்பட்ட இடம் எல்லாமே கோவா தான். பிறகு எதற்கு கோவா போலீஸ் தில்லிக்கு, தேஜ்பாலைத் தேடி செல்லவேண்டும் என்ரு தெரியவில்லை. கோவாவிற்கு வந்தால், நிச்சயம் கைது செய்யப் படுவார் என்றுதான், தேஜ்பால் தில்லியில் ஒளிந்து கொண்டிருக்கிறார் என்பது மெய்யாகிறது. மேலும், அங்கு பாஜக ஆட்சி நடப்பதாலும், ஏற்கெனவே மற்ற மனித உரிமைகள், சமூக இயக்கங்கள் இவருக்கு எதிராக இருப்பதாலும், தனக்கு சாதகமாக இருக்காது என்று நன்றாகவே தெரிந்து கொண்டிருப்பார்.

சோமாவின் இரட்டை வேடம், மாறுகின்ற நிலை: கோவா போலீஸ் சிறப்புப்படை ஒரு டிஜிபி தலைமையில் 23-11-2013 அன்று வந்தடைந்தது[6]. எண்.11, லிங் தெரு, தில்லியில் உள்ள தேபால் வீட்டின் முன்னர் ஏற்கெனவே ஊடகக் காரர்கள் கேமராக்களுடன் காத்துக் கிடக்கின்றனர். ஆனால், தேஜ்பால் வீட்டில் உள்ளாரா அல்லது வெளியே சென்று விட்டாரா என்று தெரியவில்லை. சோமா அறிவித்தப்படி, கோவா போலீசாருக்கு எந்த தகவலும் சென்று சேரவில்லை. அதாவது அவர் ஒத்துழைக்காமல், ஊடகங்களில் ஏதோ கதைவிட்டுக் கொண்டிருக்கிறார். அழாத குறையாக ஒரு ஆங்கில ஊடகத்திற்கு பேட்டிக் கொடுத்துக் கொண்டிருந்தார். நிச்சயமாக கற்பழிப்புக் குற்றத்தில் ஈடுபட்டவற்குத் துணைப் போகிறார் என்று மற்ற பெண்கள் இவரைக் குற்றஞ்சாட்டியுள்ளதில் ஆடிபோயுள்ளார் என்று நன்றாகவே தெரிகிறது. மேலும், தேஜ்பாலின் குற்றம் நிரூபிக்கப் பட்டுவிட்டால், தான் தெஹல்காவை விட்டு விலகி விடத்தயார் என்றும் கூறினார். இக்திலிருந்து, அவரது இரட்டை வேடங்கள் மற்றும் மாறிய நிலை நன்றாகவே வெளிப்படுகிறது. இதுவரை கேட்ட இ-மெயில்கள் வந்து சேரவில்லை என்று பொலீசார் கூறியுள்ளனர்[7]. ஒரு சாதாரண ஊடக நிறுவனத்தைச் சேர்ந்தவர்கள் இப்படி ஒரு மாநில முதலமைச்சர், போலீஸ் அதிகாரிகள் முதலியோரை அலைய விடுகின்றனர் என்றால் ஆச்சரியமாக உள்ளது.

ஹயத் ஓட்டல் லிப்டில் கேமராக்கள் இல்லை: மேலும் லிப்டில் எந்த கேமராவும் இல்லாததால், லிப்டில் என்ன நடந்தது என்பதைக் காட்டக்க்கூடிய ஊடகங்கள் இல்லை[8]. ஆனால், மற்ற கேமராவின் மூலம் பதிவானவற்றை போலீசார் பெற்றுள்ளனர். அவற்றின் மூலம், தேஜ்பாலை கைது செய்வதற்குத் தேவையான ஆதாரங்கள் இருப்பதாக போலீசார் நம்புகின்றனர். தில்லி வந்தடைந்த கோவா போலீசார், தில்லி போலீசாருடன் சேர்ந்து கொண்டு, தெரியாத / அறிவிக்கப்படாத இடத்தில் தேஜ்பாலை விசாரித்து வருவதாக செய்திகள் வந்து கொண்டிருக்கின்றன[9]. இன்று மாலைக்குள் கைது செய்யப்படுவார் என்றும் கூறப்படுகிறது[10].

தமிழ்  ஊடகங்களின்  நிலை, போக்கு, செய்திகள்  அறிவிப்பு: வழக்கம் போல தமிழ் ஊடகங்களுக்கு நிலைமை முழுவதும் புரியாமல், சாதாரணமாக செய்திகளை வெளியிட்டு வருகின்றன. பிருந்தா காரத், என். ராம் போன்ற மார்க்ஸியவாதிகள் தேஜ்பாலைக் கண்டித்துள்ளதால், இடதுசாரி தாக்கம் மிகுந்த தமிழ் ஊடகக்காரர்களுக்கு ஒன்றும் புரியாமல் குழம்பியிருப்பது அவர்கள் பிரயோகிக்கும் வார்த்தைகளிலிருந்தே தெந்ரிகிறது. கற்பழிப்பிற்காக எப்.ஐ.ஆர் போடப்பட்டிருந்தாலும், பிபிசி தமிழ், “தவறாக நடந்துக் கொண்டதாக”, “பாலியல் தொல்லை[11]”, “பாலியல்  வல்லுறவு  முயற்சி “  என்றுதான் வர்ணித்து வருகிறது[12]. மற்றவை,  பாலியல் பலாத்காரம், மானபங்கம், பலாத்கார முயற்சி ….. என்ற நிலையிலேயே இருக்கின்றன. அப்பெண்ணின் இ-மெயிலைக் கூடப் படிக்கவில்லை அல்லது படித்திருந்தாலும் அந்த உண்மையை சொல்லக்கூடாது என்று தீர்மானமாக உள்ளார்கள் என்று தெரிகிறது. நித்யானந்தா விசயத்தில் குதித்த தமிழ் ஊடகங்கள் இப்பொழுது அமுக்கி வாசிப்பது ஏன் என்று தெரியவில்லை. பொதுவாக குஷ்புவைக் கூப்பிட்டு கருத்து கேட்பார்கள். இம்முறை ஏன் கேட்கவில்லை என்று தெரியவில்லை.

திங்க்  –  பெஸ்ட்  –  2013 [Thinkfest 2013] சர்ச்சைகள்: திங்க்-பெஸ்ட்-2013 [Thinkfest 2013] ஆரம்பத்திலிருந்தே மிகவும் சர்ச்சைகளில் சிக்கியிருந்தது. “கோவன் சொசைடி” [Goan Society] இதை எதிர்த்து ஆர்பாட்டம் நடத்தியது. “இந்த நிகழ்சியே ஒரு மோசமான கம்பெனியின் பண உதவியில் நடத்தப் படுகிறது. மேலும், தங்களது நிலையைக் காப்பாற்றிக் கொள்ள அன்னா ஹஸாரே, மேஹ்தா பட்கர் போன்றோரை பேச அழைத்துள்ளனர். இது ஏதோ தங்களது அசிங்கமான காரியங்களை மறைத்துக் கொள்ள செய்யும் முயற்சி போன்றுள்ளது”, என்று அவர்கள் வெளிப்படையாகவே அறிவித்தனர்[13].

These same corporations sponsoring the Festival have been involved in major illegal activities such as illegal mining, the telecom scam, the Radia tapes exposure, sponsorship of the Salwa Judum, innumerable environmental violations, and displacing indigenous communities. Teheleka magazine, who brings Goa this festival, spiked a story by one of its own journalists that would have exposed the illegal mining taking place in Goa. The journalist’s investigation was later confirmed by the Shah Commission, that accused the mining industry, in collusion with politicians and government officials, of illegal mining to the tune of Rs 35,000 crores. Till date, Tehelka has remained silent on the matter. The price to register for the festival – Rs 35,000 – reflects the audience that the Festival expects to attract: the rich and the powerful. It is not an inclusive but an exclusive club even though participation  in previous festivals has been thin. We call on speakers attending to rethink their presence at this festival. To take part in this STiNKFEST is to commit yourself to the supporting those sponsors and supporters of this so-called intellectual forum that exploits the people of this country.

தெஹல்காவை எதிர்க்கும் கோவா-போராட்டக் குழு, மோடி ஆதரிக்கும் அல்லது மோடியை ஆதரிக்கும் வியாபாரக் குழுமங்கள் இவ்விழாவிற்கு பணவுதவி கொடுப்பதையும் எடுத்துக் காட்டுகின்றனர்[15]. சோமா சௌத்ரி அவ்வாறு பலரிடத்திலிருந்து பணம் பெறுவதை மறுக்கவில்லை[16], மாறாக நியாயப்படுத்தினார்[17].

“நம்மிடையே  உள்ள  காம  விலங்கு:   கற்பழிக்கப்  பட்டப்  பெண்கள்  தங்களது  கதைகளைக்  கூறுகிறார்கள்”: இதைவிட வேடிக்கை என்னவென்றல் பிப்ரவரி 1, 2013 அன்று கோவாவில் சோமா சௌத்ரி, சுஸ்ஸெட் ஜோர்டென் மற்றும் ஹரீஸ் ஐயர் போன்ற அறிவுஜீவுகள், “நம்மிடையே உள்ள காமவிலங்கு: கற்பழிக்கப்பட்டப் பெண்கள் தங்களது கதைகளைக் கூறுகிறார்கள்”, என்பதைப் பற்றி விவாதித்துள்ளனர்[18]. இப்பொழுது இந்த தெஹல்கா பெண்ணையும் அதேபோல அவளது கதையைச் சொல்ல வைப்பார்களா என்று தெரியவில்லை. சுஸ்ஸெட் ஜோர்டென் இப்பொழுது சொல்கிறார்[19], “போலீசார் பெரிதாக செய்து விடுவார்கள் என்று நினைக்கவில்லை. நாங்கள் இதே மாதிரி இன்னொரு விவாதத்தில் கலந்து கொண்டு, இதே பிரச்சினையைப் பற்றி பேசுவோம், அவ்வளவே தான்”! ஆனால், சோமா கண்டுகொள்ளவில்லை! அந்த “திங்-பெஸ்டிவல்” நவம்பர் 7 முதல் 11 வரை நடந்துள்ளதால், அக்காலத்தில் தான் இந்த “லிப்ட்-ஓரல்-செக்ஸ்” கற்பழிப்பு அல்லது கற்பழிப்பு முயற்சி நடந்துள்ளது என்றாகிறது. இத்தனை ஆண்டுகள் அந்த காம விலங்கு, தருண் தேஜ்பால் உடலில் உறங்கிக் கொண்டிருந்தது, அது நவம்பர் 7 மற்றும் 8, 2013 நாட்களில் எழுந்துவிட்டதால், ஒரு அப்பாவி பெண் பலிகடா ஆகியுள்ளாள். தருணின் அந்த முகம் வெளிப்பட்டு விட்டது[20]. அதுவும் அவள், தருணின் நண்பரின் மகள் என்று குறிப்பிடத்தக்கது. இன்று வேலை செய்யும் இடங்களில் பெண்களின் பாதுகாப்பு என்றெல்லாம் பேசப்படுகிறது. ஆனால், உயர்ந்த இடத்திலேயே இந்த அழகில் நிலை இருக்கின்றது.

போலீஸ்  வேண்டாம்,   நீதிமன்றம்  வேண்டாம்,   சட்டம்  வேண்டாம் – சோமாவின்  போக்கு (20-11-2013): தெஹல்காவின் தலைமை பத்திரிக்கை ஆசிரியர் சோமா சௌத்ரி பேசும் விதத்திலிருந்து, முகபாவத்திலிருந்து, ஏதோ அவர்தாம் நீதிபதி, தான் வேண்டியவற்றையெல்லாம் செய்து விட்டாகியது, அதனால், போலீஸ் வேண்டாம், நீதிமன்றம் வேண்டாம், சட்டம் வேண்டாம் என்ற ரீதி புலப்படுகின்றது. முதலில் இது துரதிருஷ்டமான விசயம், நடக்கக்கூடாதது, என்பது போல பேசிவந்த அம்மணி, வேறுவழியில்லாததால் பாலியல் வன்மம் நேர்ந்திருக்கக் கூடும் என்று ஒப்புக்கொண்டார். தெஹல்கா சோமா சௌத்ரி மற்றும் பிசிசிஐ ஶ்ரீனிவாசன் இருவரிடையே காணப்படும் ஒற்றுமை – குற்றங்களை அவர்களே விசாரிப்போம் என்ற போக்கு! இதற்குள், இவரது பாரபட்சம் மிக்க போக்கைக் கண்டித்து டுவிட்டரில் இந்த அம்மணியை விளாசிவிட்டார்கள்..

சோமாவின்  மாறியபோக்கு   – துரதிருஷ்டமான  நிகழ்வுகள்  என்ற  நிலையிலிருந்து  கற்பழிப்பு  வரை (21-11-2013): “திங்கட்கிழமை அப்பெண் புகார் கொடுத்தார், செவ்வாய்கிழமை தருண் மன்னிப்புக் கேட்டார்………………”, என்று சப்பைக் கட்டிக் கொண்டிருந்தார்[4]. ‘பெண் நிருபரின் புகார் பற்றி தருணிடம் நான் கேட்டபோது அவர் வேறு விதமாக கூறியுள்ளார். இருப்பினும், இதுகுறித்து மன்னிப்பு கேட்குமாறு நான் தான் தருணிடம் கூறியுள்ளேன்’ அதற்கும் பிறகு, அப்பெண் நிருபர் சொல்வது உண்மையானால், அதனை “கற்பழிப்பு” என்றும் சொல்லலாம் என்கிறார். அதாவது டிவிசெனல்களில் இதைஒப் பற்றிய விவாதங்கள் தெஹல்கா குழுமம் செய்வது சரியில்லை, குறிப்பாக தருண் மற்றும் தேஜ்பால் நடந்து கொள்ளும் விதம் தவறு என்றுதான் எடுத்துக் காட்டியுள்ளன. என்னவானாலும், நாங்கள் போலீசிடம் போக மாட்டோம் அப்பெண் வேண்டும், ஆனால் போலீசுக்குப் போகலாம், அது அவருடைய விருப்பம் என்று உறுதியாக கூறியுள்ளார்[5]. அதாவது ஒரு பெண்ணே, படித்த, மிக்க நாகரிகமான, தலைமை பத்திரிக்கை ஆசிரியர், ஒரு பெண் நிருபர், பத்திரிக்கையாளரின் நிலைப்பற்றி இவ்வளவு சாதாரணமாக எடுத்துக் கொள்கிறார் என்பது வினோதமாக உள்ளது. தில்லியில் பெண்களுக்கு பாதுகாப்பு இல்லை, ஏன் இந்தியாவிலேயே தினமும் பெண்கள் கற்பழிக்கப் பருகிறார்கள் என்றெல்லாம் வீதிகளில் போராட்டங்கள் நடத்தினார்கள். ஆனால், இப்பொழுது இவ்வளவு நடந்தும் அமைதியாகவே இருக்கிறார்கள்.

சோமாவை  கடுமையாக  விமர்சித்த  பிரபல  பெண்ணியப்  பெண்கள்: நந்திதாராவ்[6] செனலில், எப்படி பாதிக்கப் பட்ட பெண் தனது கடிதத்தில், தருண் அவளது பெண்குறியில் (வெகைனா என்று வெளிப்படையாகக் குறிப்பிட்டார்) விரலை நுழைத்தார் என்றுள்ளது கற்பழிப்புதான் என்று சாடினார். இருப்பினும் சோமா தேஜ்பாலை ஆதரிப்பது, அவரது குற்றத்தை ஆதரிப்பது, ஒத்துப்போவதற்கு சமம், இதனால், அவரும் கைது செய்யப்படலாம் என்று தனது கருத்தைத் தெரிவித்தார். மிகவும் பிரசித்தி பெற்ற வங்காள எழுத்தாளர் தஸ்லிமா நஸ்.ரீன், வழக்கறிஞர் நந்திதா ராவ்,  முதலியோர் சோமாவை சாடியே விட்டனர். பிறகு இந்த விவகாரத்தில் தருண் தேஜ்பாலை காப்பாற்ற முற்படவில்லை என்று தெஹல்கா நிறுவனத்தின் நிர்வாக ஆசிரியர் சோமா சௌத்ரி தெரிவித்துள்ளார். ஆனால், அருந்ததீ ராய் எங்கே போனார் என்று தெரியவில்லை! ஏற்கெனவே வியாழக்கிழமையன்று 21-11-2013 பிருந்தா காரத் தேஜ்பாலுக்கு சிறந்த இடம் சிறைதான் என்று காட்டமாக கூறியிருந்தார்[7]. டிவி செனல் பேட்டிகளில், “தி ஹிந்து” என்.ராமும் கடுமையாகவே விமர்சனம் செய்து, தருண் மீது தகுந்த நடவடிக்கை எடுக்க வேண்டும் என்று பேசியது சிலருக்கு வியப்பாக இருந்திருக்கும்.

என்  மீது  வழக்கு  ஜோடிக்கப்  படுகிறது – இ–மெயிலில்  உரையாடும்  தருண்  தேஜ்பால்   (22-11-2013): விசாரணைக்கு ஒத்துழைக்க தயார் தெகல்கா ஆசிரியர் தருண் கூறுகையில், ‘கடந்த வாரம் என் மீது கடுமையான குற்றச்சாட்டு சுமத்தப்பட்டுள்ளது. இதுபோன்ற துரதிருஷ்டவசமான சம்பவங்கள் வாழ்க்கையில் சில நேரம்  நடைபெறுவதுண்டு. இந்த வழக்கில் போலீசாரின் விசாரணைக்கு முழு ஒத்துழைப்பு தர தயாராக இருக்கிறேன். மேலும், குற்றம் சாட்டிய பெண் நிருபரிடம் அவர் விரும்பியபடி சோமா சவுத்ரி மூலம் மன்னிப்பு கேட்டுள்ளேன். ஓட்டல் கண்காணிப்பு கேமராவில் பதிவான காட்சிகளை வெளியிட வேண்டும். அப்போதுதான் உண்மையாக நடந்தது என்ன என்பது பற்றிதெரியவரும்‘ என்றார்[8]. ஆனால் வெள்ளிக்கிழமை 22-11-2013 அன்று தன்னை இவ்வாறு மாட்டிவிட முயற்சிகள் நடக்கின்றன, விசயங்கள் எல்லாம் ஜோடிக்கப் படுகின்றன[9]. ஆனால் உண்மை வெளிவரும் என்றும் பேசியிருப்பதாக செய்திகள் வந்துள்ளன[10]. தருண் தேஜ்பாலோ தன்னுடைய நிலையறிந்து, தன்னை எப்படி விசாரிக்க வேண்டுமோ, அப்படி விசாரித்தால் தான் விசாரணைக்கு தயார் என்பது போல அறிக்கை விடுகிறார். இல்லையென்றால் மறுத்துவிடுவார் போலும்.

முதல்  தகவல்  அறிக்கை  விவரங்கள்: தேசிய மகளின் ஆணையம் தேஜ்பாலின் மீது “முதல் தகவல் அறிக்கையைத்” தாக்கல் செய்யுமாறுக் கேட்டுக் கொண்டது[11]. இந்நிலையில் விசாரணைக்கு ஆஜராகுமாறு தருண் தேஜ்பாலுக்கு கோவா போலீசார் சம்மன் அனுப்பியிருந்தனர். இந்நிலையில் இன்று தருண் தேஜ்பால் மீது பலாத்கார முயற்சி வழக்கை கோவா போலீசார் பதிவு செய்துள்ளனர். இந்த வழக்கில் முதல் தகவல் அறிக்கை பதிவு செய்யப்பட்டிருக்கிறது. முழு விவரங்களை இங்கே காணலாம்[12].

The following is the text of the First Information Report lodged by Inspector Sunita Sawant of Goa Police Crime Branch, Dona Paula, on behalf of the State. Identifying information has been redacted.I, Sunita Sawant, Police inspector, CID Crime Branch, Dona Paula, do hereby lodge my complaint on behalf of the State as under: That on 21.11.2013, on various social sites, news channels of electronic media, news was published, stating that during the Think Fest organised in Goa between 7th and 11th Nov, 2013, by Tehelka.com, Shri Tarun Tejpal, Editor-in-Chief, allegedly outraged the modesty/sexually assaulted a female journalist of Tehelka. After seeing the said news, it was felt proper by the police department to initiate a preliminary enquiry in the matter, since the alleged incident was stated to have taken place in a hotel in Goa. In this respect as it was reported that the female victim had sent a detailed mail narrating the entire incident to Shoma Chaudhury, Managing Editor of Tehelka and the e-mail was sent to Ms. Chaudhury on her e-mail address, shoma@tehelka.com, requesting her to immediately forward the said complaint and relevant information in this regard to Crime Branch of Goa Police for further legal action. I also sent an SMS from my mobile no. [withheld] to her mobile no. [withheld]. Since no reply was received in this respect from Ms. Chaudhury, I contacted her from the Police Control room on her mobile no. [withheld] again requesting her to forward the complaint of the female victim and other relevant information as told to her. She said that she would go through the mail and do the needful in the matter. During enquiry, a copy of the information has been received from the source purported to be written/sent apparently by the alleged female victim, [name withheld]. In the said information, it is stated by the alleged female victim [name withheld] as under:[details withheld]. Taking into consideration the reports of various electronic, social and print media, and other enquiries conducted so far, and information received from sources, prima facie it appears that a cognisable offence has been committed by Shri Tarun Tejpal, Editor-in-Chief of Tehelka.com during the Think Fest held at Hotel Grand Hyatt, Hambolim, Goa, where the said accused allegedly committed the offence of sexual harassment and rape on a female journalist of Tehelka named [name withheld]. Hence, I hereby lodge my complaint on behalf of the state against Tarun Tejpal, Editor-in-Chief of Tehelka.com u/s 354-A, 376, 376 (2) IPC [outraging the modesty of a woman, rape, rape of a woman in the custody of the perpetrator].   Sd/ by Ms. Sunita Sawant, Police Inspector, CID Crime Branch, Dona Paula, Goa.

தேஜ்பாலின் மீது செக்ஸ் / கற்பழிப்பு முயற்சி விசயம் குறித்து முதல் பகுதி பதிவை இங்கே பார்க்கவும்[1]. பாதிக்கப்பட்ட பெண்ணின் இ-மெயில் கொடுக்கப்பட்டுள்ள விவகாரங்களைத் தெரிந்து கொள்ள இங்கே படிக்கவும்[2]. கற்பழிப்புக்கு / கற்பழிப்பு முயற்சிக்கபட்டதாகக் கூறப்படும் பெண் போலீசாரிடம் புகார் கொடுக்காமல், சோமாவிடம் புகார் கொடுத்ததே வேடிக்கையாக இருக்கிறது. அப்படி அப்பெண் பணிக்கப்பட்டிருக்கிறாளா அல்லது பயமுறுத்தப் பட்டிருக்கிறார்களா என்று தெரியவில்லை. அப்பெண்ணின் இ-மெயிலைப் படிக்கும் போது அவளை தருண் தேஜ்பால் நன்றகவே மிரட்டியிருக்கிறார் என்று தெரிகிறது.

சோமா சௌத்ரி மற்றும் தருண் தேஜ்பால் உறவுகள்: சோமா சௌத்ரி என்ற இப்பொழுதைய ஆசிரியை, நிச்சயமாக தேஜ்பாலை – தன்னுடைய “தெய்வீகத் தந்தையை” காப்பாற்ற நினைக்கிறார் என்பது தெரிகிறது[3]. ஆனால், “பத்திரிகையின் நிர்வாக ஆசிரியர், பாதிக்கப்பட்டதாக கூறப்படும் பெண், தருண் தேஜ்பால் மன்னிப்பு கேட்க வேண்டும் என மட்டும் தான் கோரியுள்ளார். தருணும் மன்னிப்பு கேட்டுள்ளார். எனவே, இதில் வேறு பிரச்னைக்கு தேவையில்லை என கூறியுள்ளார். ஆனால், இது சட்டப்பூர்வமான வழக்கு அல்ல. இப்பிரச்சனையை அலுவலக மட்டத்தில் தீர்த்துகொள்ள முடிவெடுத்தோம்; இந்த வழக்கை அந்த பெண் தொடர்ந்திருக்கவில்லை”, என்றும் செய்தி ஆசிரியர் சோமா சௌத்ரி கூறியுள்ளார்[4]. அதற்கும், பல தரப்பினர் கண்டனம் தெரிவித்து வருகின்றனர்[5].  மேலும் சோமாவிற்கு இவ்விசயம் தெரிந்திருந்தும், வேண்டுமென்றே காலந்தாழ்த்தினார் என்றும் கூறப்படுகிறது. அப்பெண்ணின் நண்பர்களில் ஒருவர் இ-மெயில்களை ஊடகங்களுக்கு அனுப்பியப் பிறகு, வேறு வழியில்லாமல், டெஹல்கா-குழிவினர் பேசி, தீர்மானித்து, ஏதோ நடவடிக்கை எடுப்பதைப் போன்ற தோற்றத்தை உருவாக்கியிருக்கிறார்கள் என்ற குற்றச்சாட்டு வலுவடைந்துள்ளது. இருப்பினும் சோமா இவற்றை மறுக்கிறார்[6].

“நம்மிடையே உள்ள காமவிலங்கு: கற்பழிக்கப்பட்டப் பெண்கள் தங்களது கதைகளைக் கூறுகிறார்கள்”: இதைவிட வேடிக்கை என்னவென்றல் பிப்ரவரி 1, 2013 அன்று கோவாவில் சோமா சௌத்ரி, சுஸ்ஸெட் ஜோர்டென் மற்றும் ஹரீஸ் ஐயர் போன்ற அறிவுஜீவுகள், “நம்மிடையே உள்ள காமவிலங்கு: கற்பழிக்கப்பட்டப் பெண்கள் தங்களது கதைகளைக் கூறுகிறார்கள்”, என்பதைப் பற்றி விவாதித்துள்ளனர்[7]. இப்பொழுது இந்த தெஹல்கா பெண்ணையும் அதேபோல அவளது கதையைச் சொல்ல வைப்பார்களா என்று தெரியவில்லை. சுஸ்ஸெட் ஜோர்டென் இப்பொழுது சொல்கிறார்[8], “போலீசார் பெரிதாக செய்து விடுவார்கள் என்று நினைக்கவில்லை. நாங்கள் இதே மாதிரி இன்னொரு விவாதத்தில் கலந்து கொண்டு, இதே பிரச்சினையைப் பற்றி பேசுவோம், அவ்வளவே தான்”! ஆனால், சோமா கண்டுகொள்ளவில்லை!

நண்பர், வேண்டியவர், நன்கு தெரிந்தவர் விசாரிக்கப் போகிறாராம்: ஊர்வசி பூடாலியா என்ற பெண் எழுத்தாளர் தலைமையில் இவர் விசாரிக்கப் படுவார் என்று சோமா சௌத்ரி அறிவித்திருப்பதே வேடிக்கையாக இருக்கிறது. ஏனெனில், இவர்கள் எல்லோருமே ஒருவருக்கொருவர் மிகவும் நெருக்கமானவர்கள். தெஹல்காவில் எழுதி வருபவர்கள்[9], இலக்கிய விழாக்களில் ஐந்து நட்சத்திர ஓட்டல்களில் ஜாலியாக, சொகுசாக உட்கார்ந்து கொண்டு பேசி மகிழ்பவர்கள். இருவர் மற்றொருவரை அழைத்து உபசரிப்பார். பதிலுக்கு அடுத்தவர், அதேமுறையை பரிமாற்றமாக செய்து காட்டுவார். விருதுகளும், பட்டங்களும் அவ்வாறே பரிமாற்றத்தில் கொடுக்கப் படும். ஆனால், தேஜ்பால், விசாரணைக்கு முன்பாகவே, ஆறு மாத தண்டனை கொடுத்து மறைவாகி விட்டாராம். சட்டரீதியில் இப்படி வேண்டியவர்கள் விசாரணையில் இருக்கக் கூடாது என்றுள்ளது. முன்பு ஶ்ரீனிவாசன் விசயத்தில் குதித்த ஊடகங்கள் இப்பொழுது அமைதி காப்பதைக் கவனிக்கலாம்.

தேஜ்பால் இந்தியாவில் தான் இருக்கிறார், ஓடிவிடவில்லை: இந்தியாவை விட்டே சென்று விட்டார். என்றும் சில செய்திகள் கூறுகின்றன. ஆனால், சோமா நாங்கள் ஒன்றும் ஓடிப்போகின்ற ஆட்கள் இல்லை என்று அடித்துக் கூறுகின்றார்[10], தேஜ்பால் இந்தியாவில்தான் இருக்கிறார் என்கிறார்[11]. பெரும்பாலும், இவர்கள் வெளிநாடுகளில் தான் சுற்றிக் கொண்டிருக்கிறார்கள். எப்பொழுதாவது தான் இந்தியாவிற்கு வருகிறார்கள். வந்தாலும் ஐந்து நட்சத்திர சொகுசு வாழ்க்கை வாழ்ந்து சென்று விடுகிறார்கள். பிறகு எப்படி இவர்களுக்கு இந்தியாவின் தன்மைகள் தெரியவரும், புரியவரும் என்பது புதிராகத்தான் உள்ளது.

காங்கிரஸும், இவ்விவகாரமும்: நிச்சயமாக தேஜ்பால் காங்கிரஸுக்கு வேண்டியவர் என்று தெரிகிறது. 2004ல் காங்கிரஸ் பதவிக்கு வந்தவுடன், தம்மீதுள்ள வழக்குகளிலிருந்து விடுவிக்க பிரதம மந்திரியிடம் கேட்டுள்ளதாகத் தெரிகிறது. உடனே, அவர் சோனியா காந்திக்கு எழுதியுள்ள கடிதம் அதனை உறுதிப் படுத்துகிறது. அவ்வழக்குகளில் கூட, இவரது கூட்டாளி அநிருத்த பஹல் [Anirudh Bahal and Mathew Samuel] கைது செய்யப்பட்டால் கூட, பிறகு விடுவிக்கப் படுகிறார். அதுமட்டுமல்லாது, தேஜ்பால் அவ்வழக்கை தில்லுக்கு மாற்ற முறையிடுகிறார். அவ்வாறே மாற்றப் படுகிறது. பிறகு, என்னவாயிற்று என்று ஊடகங்களில் விசயங்கள் வரவில்லை. ஆனால், மற்ற ஊடகக்காரர்கள் வியக்கும் வண்ணம் தேஜ்பால் உயர்ந்து கொண்டே போனார். எப்பொழுதும் அயல்நாட்டவர்களின் கூட்டம், தூதரகங்களுடம் நெருக்கம், பார்ட்டிகள் என்று பெரிய ஆட்களுடன் தான் சேர்ந்து பழகி வந்தார். இதெல்லாம், காங்கிரஸுடனான மிகவும் நெருங்கியுள்ள நிலையைக் காட்டுகிறது. கோவாவில் IFFI மணீஸ் திவாரி பேசும்போது, “இது மிகவும் முக்கியமான விசயம், ஜாக்கிரதையாக செயல்பட வேண்டியுள்ளது. இதற்கு நாங்கள் சொல்ல்வேண்டியது யாதாவது இருப்பின், உரியநேரத்தில், தேவைப்பட்டால் சொல்லப்படும்”, என்றார்[12]. இதே குஜராத் டேப் விசயத்தில் படுநக்கல் அடித்து, “சாஹப்ஜாதா” என்று கமென்ட் அடித்து பேசினார்.

தேஜ்பாலின் மீது செக்ஸ் / கற்பழிப்பு முயற்சி விசயம் குறித்து முதல் பகுதி பதிவை இங்கே பார்க்கவும்[1]. ஆங்கிலத்தில் இப்படி சொதப்பலாக இவர்கள் வளவளவென்று எழுதி இந்தியர்களை ஏமாற்றப் பார்க்கிறார்கள். என்னத்தான் படித்திருந்தாலும், இந்திய கலாச்சாரத்தை துறந்து, மேனாட்டு மோகத்தில் திளைக்கும் ஊடகக் காரர்களிடம் நாம் எந்தவித ஒழுக்கத்தையும் எதிர்பார்க்க முடியாது.

தருண் தேஜ்பாலின் மன்னிப்புக் கடிதம் கீழ்கண்டவாறு உள்ளது[2]:

My dear Shoma,The last few days have been most testing, and I squarely take the blame for this. A bad lapse of judgment, an awful misreading of the situation, have led to an unfortunate incident that rails against all we believe in and fight for. I have already unconditionally apologised for my misconduct to the concerned journalist, but I feel impelled to atone further. Tehelka has been born and built, day on day, with my blood, toil, tears and sweat, and that of many others, against near-insurmountable odds. It has lived for and fought the big battles of our time, always on the side of the oppressed and the wronged, always on the side of equity and justice. Its voice has travelled the world and changed policy and perceptions. It has been a beacon for those who would do the right thing. Through bad, and worse, times I have protected Tehelka and its journalists from the inevitable demands of power and corporations. I have always allowed every journalist’s sense of the right to flower and express itself. No one has ever been asked to do what they don’t believe in. I have always held that Tehelka the institution, and its work, have always been infinitely more important than any of us individuals. It is tragic, therefore, that in a lapse of judgment I have hurt our own high principles. Because it involves Tehelka, and a sterling shared legacy, I feel atonement cannot be just words. I must do the penance that lacerates me. I am therefore offering to recuse myself from the editorship of Tehelka, and from the Tehelka office, for the next six months. You have always been stellar, Shoma, and even as I apologise to you and all my other colleagues, for this unfortunate incident, I leave Tehelka in your more than capable and safe hands. [“Once the matter is brought to the National Commission for Women, we will investigate and ensure that the accused gets punishment, if found guilty. He will have to face a trial in the court. Tarun Tejpal is no God to decide his own course of punishment,” said Mamata Sharma, who heads the  National Commission for Women[4].]. ஆனால், இந்த அறிவுஜீவிகளின் கருத்தும் வினோதமாக உள்ளது. கடவுளை விமர்சிக்கிறாரா அல்லது தருணுக்கு வக்காலத்து வாங்குகிறாரா தேசிய மகளிர் ஆணையத்திற்குத் தலைவராக இருப்பதினால் இப்படி சப்பைக் கட்டுகிறாரா என்பது அவருக்குத்தான் புரியும்.

Following is the statement by Tehelka on the panel:In furtherance to Tehelka’s acceptance of Tarun Tejpal’s recusal from editorship of Tehelka on November 20th, which followed the official unconditional apology he had mailed to the journalist concerned on November 19th, Tehelka has now constituted a formal complaints committee, in accordance to Vishaka guidelines, to be presided over by Urvashi Butalia, eminent feminist and publisher, to investigate the matter. The other members of the committee will be announced shortly. In addition to this, Tehelka will ensure setting up a formal complaints committee, according to section 4 of the Sexual Harassment of Women (Prevention, Prohibition and Redressal Act, 2013), an institutional mechanism that was sorely missing in Tehelka. Here is the complete e-mail of the victim to Tehelka;s Managing Editor Shoma Chaudhury:Dear Shoma, It is extremely painful for me to write this email to you – I have struggled with finding an easier way to say it, but there isn’t one. The editor in chief of Tehelka, Tarun Tejpal, sexually assaulted me at Think on two occasions last week. From the very first moment, I wanted to call you, or find you and tell you what he had done to me – but given how absorbed you were at Think; preparing for and conducting sessions, and the fact that it was impossible for the two of us to get even a minute alone together, I could not. To add to this, I had to process the fact that it was Tarun who molested me — my father’s ex colleague and friend, Tiya’s dad, and someone I had so deeply respected and admired for so many years. Both times, I returned to my room in a completely distraught condition, trembling and crying. I went straight to Shougat and Ishan’s room, where I called G Vishnu and told them what had been done to me. (All three of them are copied on this email. You can contact them for any clarifications you see necessary). The second time he molested me, I even told Tiya what happened. When he heard I’d told Tiya (she confronted him), he lashed out at me, and I became truly terrified of what he would do. I avoided him in all situations except in rooms full of people, until I checked out of Think on Sunday. As of Saturday evening, he sent me text messages insinuating that I misconstrued “a drunken banter”. That is not what happened. Banter does not involve forcing yourself on someone, trying to disrobe them, and penetrate them with your fingers despite them pleading for you to stop. As you read through the details of what happened in the attachment to this mail, I hope you will also understand how traumatic and terrifying it has been for me to report this to you — and yet how critical it is that Tehelka constitute an anti sexual harassment cell as per the Vishakha guidelines immediately, to investigate this matter. At the very least, I will need a written apology from Mr Tejpal and an acknowledgement of the same to be circulated through the organization. It cannot be considered acceptable for him to treat a female employee in this way. On the night of 7th November 2013, the opening night of Tehelka’s Think festival, I had discharged my duties for the day as the chaperone for Mr Robert De Niro. As it was Mr De Niro and his daughter’s first night in Goa and at the festival, my editor in chief Mr Tarun Tejpal accompanied Mr De Niro, Drena De Niro (his daughter) and I to Mr De Niro’s suite to wish him goodnight. (As his chaperone, my work was to be available all day to Mr De Niro and Drena, take them sightseeing, make sure they were well looked after in Goa and at the Hyatt – until they retired to their suite at night. ) As we left the suite, Mr Tejpal and I were in conversation — I have known him since I was a child, he had worked closely with my father who was also a journalist, and after my father’s accident Mr Tejpal had always been a paternal figure to me. He was responsible for offering me my first job, and was always just a phone call away whenever I needed his advice on a story or life. His daughter, Tiya Tejpal and I are very close friends as well. As we made our way out of the elevator of Block 7 at the Grand Hyatt, Mr Tejpal held my arm and pulled me back into the lift. He said – “Let’s go wake up Bob” (Mr De Niro) and I asked him why he wanted to do that. I then realized that Mr Tejpal was simply pressing buttons on the lift’s panel to make the elevator stay in circuit, preventing it from stopping anywhere, and for the doors to open. At this point, he began to kiss me — from the first moment of his doing so, I asked him to stop, citing several reasons, including my friendship to Tiya, my closeness to his family, the fact that he had known me since I was a child, the fact that I worked for Tehelka and for Shoma Chaudhury – who is my managing editor and mentor. It was like talking to a deaf person. Mr Tejpal lifted my dress up, went down on his knees and pulled my underwear down. He attempted to perform oral sex on me as I continued to struggle and hysterically asked him to stop. At that moment he began to try and penetrate me with his fingers, I became scared and pushed him hard and asked him to stop the lift. He would not listen. The lift stopped on the ground floor as Mr Tejpal’s hands were on me and could not press the button for yet another floor to keep it in circuit. As soon as the doors opened, I picked up my underwear and began walking out of the elevator rapidly – he was still following me, asking me  what the matter was. I said “It’s all wrong. I work for you and Shoma.” He said first “It’s alright to be in love with more than one person,” and then he said, “Well, this is the easiest way for you to keep your job.” I was walking still faster, blinking back tears. By this time, we had made our way from Block 7 to the main lawns of the Grand Hyatt, where I walked into the grassy dinner area full of people and Mr Tejpal walked off towards the performance area. Right as soon as he was out of sight, I took a taxi back to my hotel – the International Centre for Goa, where the Tehelka staff was staying, and went to the room where the Literary Editor Shougat Dasgupta and the Photo Editor Ishan Tankha were staying. I also called another friend and colleague – investigative reporter G Vishnu to the room and told them what had occurred. While the four of us were talking in the balcony, Mr Tejpal sent me a text message from his personal phone number at 1.17 am, which said “The fingertips”. This was the extent he had managed to penetrate me before I pushed him and ran out of the lift. I told the people with me on the balcony about this. Some of us considered resigning as soon as Think was over. I called my boyfriend Aman Sethi in Addis Ababa, Ethiopia, from Ishan Tankha’s iPhone and told him what had happened. I was confused, hurt and really, really scared. At that point I did not want to lose my job. And so the next morning, I went about my work determined not to give Mr Tejpal or Tehelka a reason to fire me, as I was sure they would do once this story got out. At a few points of the day, I discussed the events of the previous night with Shougat Dasgupta, G Vishnu and Ishan Tankha, who were concerned about me after the state they had seen me in the previous night. In the afternoon, I accompanied Mr De Niro, his daughter, Sir VS Naipaul, Lady Naipaul and Mr Tejpal’s wife to the Governor’s bungalow for lunch. Given the company we were in, I did not make any mention of what had occurred to Ms Geetan Batra, Mr Tejpal’s wife. Once I had escorted Mr De Niro back to his room post lunch, he expressed a desire to attend one of the sessions at the Main Hall. I brought him down to the Green Room, where Mr Tejpal found us, and asked me to bring Mr De Niro back down for Mr Amitabh Bachchan’s session as he wanted the two to meet. I took Mr De Niro and his daughter shopping to Panjim, and brought them back in time for Mr Bachchan’s session as instructed. Once the session was done, Mr Tejpal, Mr De Niro, Mr Bachchan and a few other members of the film industry, lawyers, politicians etc were supposed to meet at the Block 7 Grand Club for drinks. I escorted Mr De Niro and Drena to this bar, told them I would return to my hotel, change, and be right back. While I was getting dressed at my hotel, Mr Tejpal called me from ThakurJi’s phone (Thakurji is the caretaker and manager of Tehelka’s Bombay office premises) and asked me where I was. I informed him I was just about to leave for the Grand Hyatt. In the taxi I noticed he had already sent me two text messages on my phone which said “Where r u?” at 8:29and then “??” at 8:42. from his personal number. I replied with the following messages: “On my way to the lounge” 8.42 pm, “Had to sort out a lost package for Drena and get a bit presentable. See you in 10” at 8.44 pm and “Call tee she needs you” at 8.47 pm as Tiya had messaged me asking to help her find Tarun. At this point I was trying to be as normal and professional as possible and somehow get through my duties. Five minutes later, as I was walking into the Grand Club at Block 7, Mr Tejpal was coming out of the lounge. He pointed at me asking me to stop. I was already worried that I was late and that Mr De Niro had asked for me. Mr Tejpal came to me and said “Come up with me, we have to get something from Bob’s room”. I was frightened that this would lead to a repeat of the previous night and so I said, “What does he need? I’ll go get it.” I was scared of getting into the lift with him again, and more terrified that he was going to try and take me into a room this time. By this time he was holding me by the wrist and had taken me into the lift (which is barely a few steps away from the lobby of block 7 where he had asked me to wait). When the doors closed, he started to try and kiss me again. I said “Tarun, please, no, just stop,” he pulled away, smiled, patted my cheek and said “Why? Ok. I’ll stop.” I said again “This just isn’t right. Tiya is my best friend. I had lunch with Geetan today. “ He smiled again and just for a moment I thought I had appealed to his better sense. I turned away from him, desperately waiting for the door to open (there are only three floors in Block 7 (G, 1 and 2), we were between floors). Within seconds of my turning around, he started to lift up my dress. He lifted it all the way up and said “You’re unbelievable”. The door opened on the second floor, on Mr De Niro’s floor —  and he said again – “The universe is telling us something” to which I said “I’m taking the stairs” and started to walk out. He pulled me back in, sensing that I was on the verge of hysteria — by this point, he was totally comfortable physically manhandling me, but sensing my sheer panic, he did not touch me until the lift reached the ground floor. Right as the doors were about to open, he patted my behind once more. I walked out of the lift, went to the Grand Club and immediately informed Ishan Tankha that Mr Tejpal had tried to molest me again. Ishan said “Again? What the fuck is wrong with him?” He was completely disgusted and said once more that we should just resign immediately. As I was to accompany Mr De Niro to the dining area, I somehow composed myself. Mr De Niro was mobbed by fans – and I had to take him away from the main garden to the Capiz Bar. I was sitting at the Capiz Bar with Mr De Niro and his daughter when TiyaTejpal came there to join us. This was the first time the two of us had really met since the incident of the previous night. Since I had moved to Mumbai about a year and a half ago, Tiya had grown to become one of my closest friends. She lives across the road from my house in Mumbai and barely a day had passed when the two of us did not meet or talk to each other constantly. She was sitting beside me, and Mr De Niro was absorbed in conversation with his daughter. I could not keep something of this magnitude from her. I told her she would hate me for what I was telling her – but that Mr Tejpal had tried to molest me on these two separate occasions. I said “He tried to shove his tongue down my throat and then took my panties off”, when Tiya replied saying “I saw him do this to a woman when I was thirteen, so it doesn’t surprise me anymore,” but she was clearly disgusted. Tiya left the Capiz Bar right after this. In half an hour, Mr De Niro and Drena asked to be dropped back to their room. They were extremely upset at the day’s events because Mr De Niro had all but been assaulted by fans at the dinner table, and they asked me to convey this to Mr Tejpal. When I came down from Block 7, I found Mr Tejpal sitting at a table with several people and called him away from the table, but still in full view of everyone, so I could relay Mr De Niro’s message privately. I said “Bob is really upset about tonight, he got mobbed really badly..” to which Mr Tejpal replied “I don’t give a fuck about Bob. How could you tell Tiya what happened?” I said “Tarun, I told you Tiya and I are close and what you did wasn’t okay, I had to tell her,” to which he said “She’s my daughter. Do you even understand what the word means? Just get away from me, I’m so fucking pissed off with you right now.” I left from the spot crying, found Tiya outside her room in the main performance area and asked her what she had said to her father. She said “There was no other way. As soon as you told me I wished you hadn’t, but you can’t tell me what to say to him – I told him to keep it in his pants.” I said “I’m probably going to lose my job over this”, she agreed, but also said “It’ll be a bad phase but it’ll pass.” On this night as well, I left the Grand Hyatt and went to my hotel, found Shougat Dasgupta, Ishan Tankha and G Vishnu and told them what had happened. I also called my boyfriend and told him that Mr Tejpal was aware of the fact that I wasn’t staying quiet, and that he was extremely angry that I had told his daughter. The next morning, I called my mother and told her everything that had happened. Everyone was most worried for my safety and advised me to leave Think as soon as possible — however since my day’s work involved me staying away from the Grand Hyatt and staying at a completely different part of Goa for the day with Mr De Niro and his daughter, I felt temporarily safe. At this time MrTejpal sent me the following texts from his personal number. 1. “I hope you told Tiya that it was just drunken banter, and nothing else” To which I replied – “I told her we were both drunk” – because it was true that everyone had had a few drinks on the first night. But not the second, when he assaulted me minutes after I had reached the Grand Hyatt. However, this was the first time Mr Tejpal had said anything to me after lashing out at me the previous night, and I was still very afraid of him. He then sent me a second message: 2. “And just banter, nothing else” – to which I did not reply, because there was no way what he had done to me could have been described as “banter”. Sensing that I had clammed up at his attempt to sugar-coat what really happened, he sent me a third message: 3.  “Why?? What’s happened??” I did not reply to this message. Within minutes, he sent me a fourth message, one that convinced me he saw absolutely nothing wrong with what he had done, and was in fact now trying to shame me for talking to Tiya: 4. “I can’t believe u went and mentioned even the smallest thing to her. What an absence of any understanding of a parent child relationship.” After this message, I made sure to stay away from Mr Tejpal except when we were in extremely public situations only – such as the Speakers Green Room at the Hyatt, or the lobby of the hotel. That evening as well, I steered completely clear of him. He made no mention of anything that had occurred the next day, and the only thought on my mind was to get Mr De Niro on his plane and leave Think. I had to speak to MrTejpal several times on Sunday the 9th of November to coordinate Mr De Niro’s travel plans, but in these calls he made no mention of anything that had occurred. Once I dropped Mr De Niro to the Goa Airport at 4.30 pm, I had no further contact with Mr Tejpal. However, on 16.11.2013, Mr Tejpal messaged me a number of times 1.“Have you spoken to Tee? Is she Ok?” To which I replied: “Why would she be ok about the fact that you sexually assaulted her best friend, that is me?” 2.    “What’s with saying this awful stuff??” To which I replied: Do not send me any messages. You are lying and you know that. 3.    “Oh is that so? I cherished you like one of my best kids always, all these years; and because of one drunken banter you so easily say these awful things. To which I replied: It was twice Tarun, not once and it was no banter. You did the most horrible things to me and I certainly was not drunk. I asked you to stop repeatedly. 4.    “Oh so that’s what you told Tee. No wonder she’s so madly upset. Its ok. Am not going to contest anything with her. Will let time and my love heal what it can.” 5.     “Don’t think I’ve been more saddened in the longest time” I have no doubt that Mr Tejpal was trying to establish his innocence in a devious manner. If he needed to get in touch with his daughter, he could have done so anytime he desired, through his wife or daughter or nephew or anyone from his family without messaging me about her, or falsely claiming that all that happened was ‘a drunken banter’. This was no banter, it was most clearly sexual assault. As a reporter for Tehelka who writes on violence against women, I suddenly find myself in the horrific situation of discovering what it is like to be on the receiving end of this violence from a powerful man I once deeply admired and respected. I truly hope that the idea of Tehelka is still intact – and that you will conduct an inquiry into this matter at the earliest.

மேனாட்டு நாகரிகத்தில் திளைக்கும் தருண் தேஜ்பால்: புலனாய்வு வார பத்திரிகையான, தெஹல்கா ஆசிரியர், அருண் தேஜ்பால், பெண் பத்திரிகையாளர் ஒருவரிடம் தவறாக நடக்க முயன்றதாக கூறப்படும் விவகாரம், பூதாகாரமாக உருவெடுத்துள்ளது. ஒரு ராணுவகுடும்பத்தில் 1963ல் பிறந்த தேக்பால், மேனாட்டு நாகரிகத்தில் ஊறிய மனிதர். 2000 வருடத்தில் தஹல்காவை ஆரம்பித்து, 2001லேயே ஆசியாவின் 50 தலைவர்களில் ஒருவர் என்ற புகழ் பெற்றாறாம்! 2009லேயோ மிகவும் சக்தி கொண்ட மனிதர் என்ற நிலையை அடைந்தாராம்!! கீதன் பாத்ரா என்பரை மணந்து கொண்டார். ஆனால், இவர் மற்ற பெண்களுடனும் நெருக்கமாக இருப்பது போல் புகைப்படங்கள் காட்டுகின்றன. ரீடா பீமானி என்பருடன் ஒரு பார்ட்டியில் எடுத்துக் கொண்ட புகைப்படம் உதாரணத்திற்குக் கொடுக்கப்படுகிறது[1] [Author Tarun Tejpal with Rita Bhimani]. தனிமனிதருடைய வாழ்க்கையில் மூக்கை நுழைக்கக் கூடாது, ஏனெனில் அவருடைய உரிமைகளில் தலையிடக் கூடாது என்றெல்லாம் இப்பொழுது வாதிக்கப்படுகிறது, அறிவுருத்தப் படுகிறது. ஆனால், இவர்களுக்கு அந்த யோக்கியதை இருக்கிறதா என்று பொது மக்களும் விவாதிக்க உரிமையுள்ளது. அவருடைய புத்தக வெளியீட்டு விழாக்கள் எல்லாமே குடி-கூத்து-கொண்ட்டாடம் என்றுதான் இருக்கும்[2].

பாஜகாவின் தர்மசங்கடமான நிலை: ஸ்னூப்பிங், ஸ்டாக்கிங் விசயங்களில் கவலையுடன் இருக்கும் பாஜகவிற்கு சிறிது தெம்பு வந்து விட்டது எனலாம். ஒரு பெண்ணிற்கு, அவளது தந்தையின் வேண்டுகோளுக்கு இணங்க நாங்கள் கண்காணித்ததையே பெண்ணின் உரிமைகளை மீறிய செயல், மோடி பதவி விலக வேண்டும், தேர்தலிலொ நிற்கக் கூடாது என்றெல்லாம் கலாட்டா செய்த காங்கிரஸ் அமைதியாகி விட்டது. அந்த அதிரடி பெண்மணிகள் மறுபடியும் கூட்டம் கூட்டுவார்களா என்று தெரியவில்லை. அவர் மீது தகுந்த நடவடிக்கை எடுக்க வேண்டும் என, பா.ஜ., வலியுறுத்தியுள்ளது. பா.ஜ., தலைவராக, 2001ல், பங்காரு லட்சுமண் இருந்த போது, ரகசிய, வீடியோ நடவடிக்கையில், அவர் பணம் பெற்றதை, தெஹல்கா டாட் காம் என்ற, இணையதளம் அம்பலப்படுத்தியது. இதையடுத்து, அவரின் பதவி பறிக்கப்பட்டது. இது போல், பல விவகாரங்களில், இந்த ஊடகம், ரகசிய வீடியோ நடவடிக்கைகளை மேற்கொண்டு, பலரின் பதவிகளையும், அதிகாரங்களையும் பறிக்கச் செய்துள்ளது.

லிப்டில் கட்டிப் பிடித்தார், …….., முத்தமிட்டார், சில்மிஷம் செய்தார்…………, இப்படி புகார் செய்யும் பெண்செய்தியாளர்: முதலில் இணையதளமாக வெளிவந்த அந்த ஊடகம், இப்போது, வார பத்திரிகையாக வெளிவருகிறது. அந்தப் பத்திரிகையின் ஆசிரியராக இருக்கும், தருண் தேஜ்பால், தன்னுடன் பணியாற்றும் பெண் பத்திரிகையாளர் ஒருவரிடம், அநாகரிகமாக நடந்து கொண்டார் என, அந்த பெண் பத்திரிகையாளர், நிறுவனத்தின் நிர்வாக ஆசிரியருக்கு, இமெயில் மூலம், இரண்டு நாட்களுக்கு முன் புகார் அனுப்பினார். பத்து நாட்களுக்கு முன், கோவா நட்சத்திர ஓட்டலில், லிப்டில் ஏறும் போது, தன்னை பலவந்தமாக இழுத்து, தன் பக்கம் அணைத்துக் கொண்டார் என, அந்தப் பெண் கூறியுள்ளார்; இதற்காக அவர் மன்னிப்பு கேட்க வேண்டும் என்றார். இப்படி இரண்டு முறை என்னிடம் தகாத முறையில் நடந்துகொண்டார் என்று பெண் பத்திரிக்கையாளர் ஒருவர் குற்றம் சாற்றினார்[3].  இமெயிலில் உள்ளவற்றை அப்படியே போடாமல், ஊடகங்கள் அமுக்கி வாசித்துள்ளன.

ஆறுமாதம் வனவாசம் என்றால் போன மானம் / கற்பு திருப்பி வந்துவிடுமா?: கற்பழிப்புக்கு / கற்பழிப்பு முயற்சிக்கூபட்டதாகக் கூறப்படும் பெண் போலீசாரிடம் புகார் கொடுக்காமல், சோமாவிடம் புகார் கொடுத்ததே வேடிக்கையாக இருக்கிறது. அதையடுத்து, செவ்வாய்க்கிழமை தாமாக முன்வந்து, பத்திரிகை ஆசிரியர் பொறுப்பிலிருந்து, ஆறு மாதம் விலகிக் கொள்வதாக, தருண் தேஜ்பால் அறிவித்தார்.  இது வெவேக் ஜோக் மாதிரி இருக்கிறது. ஒரு குஞ்சுமோனன் கற்பழித்து ரூ.5,000/- அபராதம் கட்டிவிட்டு, அடுத்த பெண்ணைக் கற்பழிக்க அட்வான்ஸ் கொடுத்த கதையாகி விட்டது! மேலும், “கற்பழிப்பு” என்றல் என்ன என்றும் புரியாமல் போய்விட்டது. மானபங்கம், பெண்டாலல், கட்டிப்பிடித்தல், முத்தம் கொடுத்தல், மார்பகங்களைப் பிடித்தல் / அமுக்குதல், இடுப்பில் கைவைத்தல், இப்படி செய்வதில் எது எந்த அளவில் என்ரு தெரியவில்லை. கைபிடித்தால் கூட மானபங்கம் செய்துவிட்டதாகக் கருதப்படுவதால், இப்பொழுதைய கற்பு / கற்பழிப்புக் கொள்கைகள் விவாதங்கள் நவீனப்படுத்தப் பட்டதாகத் தெரிகிறது.

தேசிய மகளி ஆணையம், போலீசார் நடவடிக்கை எடுப்பார்களா?: இந்த விவகாரம், புதன்கிழமையன்று பத்திரிகைகளில் வெளியானதை அடுத்து, தெஹல்கா ஊடகத்தால் பாதிக்கப்பட்டவர்கள் மற்றும் கட்சிகள், தருண் தேஜ்பால் மீது நடவடிக்கை எடுக்க வேண்டும் என, வலியுறுத்தி வருகின்றனர். தெஹல்காவின் இப்பொழுதைய ஆசிரியை சோமா மழுப்பலாக பதி அளித்து சமாளித்து வருகிறார். இது ஏதோ அவர்களது வீட்டுப் பிரச்சினை போல பேசி வருகிறார்[4]. வேடிக்கை என்னவென்றால், தேசிய மகளிர் ஆணையம் காங்கிரஸ் சார்பாக செயல்பட்டு வருகிறார். அவருடைய பெயர் ராஜஸ்தான் தொகுதியில் வேட்பாளராகக் குறிப்பிடப்பட்டுள்ளது. இந்த தேஜ்பாலோ “பிரச்சார் பாரதி” குழுவின் உறுப்பினராக பரிந்துரைக்கப் பட்டுள்ளார். இப்படி காங்கிரஸ் ஆதரவுன் இருக்கும் இவர்மீது நடவடிக்கை எடுப்பது சந்தேகமே என்ற கருத்து பலமாக இருக்கிறது.

கோவா முதலமைச்சர் தயங்குவது ஏன்?: பாஜக ஆட்சி நடக்கும் கோவாவில், அதன் முதலமைச்சர் முதலில் இவ்விவகாரம் குறித்து தயங்கியதாகத் தெரிகிறது. ஏனெனில், கோவாவில் இத்தகைய செக்ஸ் விவகாரங்கள் சாதாரமாக இருக்கின்றன. அயல்நாட்டுக்காரர்கள் அனுபவித்து வரும் நிலையில் அவர்கள் புகார் செய்வதில்லை. ஆனால், இந்தியர்கள் அயல்நாட்டவரைத் தொட்டுவிட்டால், புகார் எழுகின்றது. மேலும், பாஜகவின் மீதே ஸ்னூப்பிங் / ஸ்டாக்கிங் புகார் உள்ளதா நடவடிக்கை எடுக்கலாமா-லூடாதா என்று தயங்கியிருப்பார் போலும்! எடுத்தால் பாஜக ஆட்சி என்பார்கள் எடுக்காவிட்டால், அவர்களே மாட்டிக் கொண்டிருப்பதால் சமாளிக்கிறார்கள் என்பார்கள். இருப்பினும், சம்பவம் நடந்ததாக கூறப்படும், கோவா மாநிலத்தின், பா.ஜ., முதல்வர், மனோகர் பாரிக்கர், தருண் தேஜ்பாலை கைது செய்து விசாரணை நடத்த வேண்டும், என, கூறியுள்ளார். தேசிய மகளிர் ஆணையம், தருண் தேஜ்பாலால் பாதிக்கப்பட்ட பெண், போலீசில் புகார் அளித்து, வழக்கு தொடர வேண்டும் என தெரிவித்துள்ளது[5]. அந்த பெண்ணும் உச்சநீதி மன்றத்தில் விஷாகா தீர்ப்பில் கொடுக்கப்பட்டுள்ள விதிமுறைகளை பின்பற்றி தேஜ்பாலின் மீது நடவடிக்கை எடுக்க்க வேண்டும் என்று கோரியுள்ளாள்[6].

சோமாவின் ஆதரிக்கும், சமாளிக்கும் போக்கு: சோமா சௌத்ரி என்ற இப்பொழுதைய ஆசிரியை, நிச்சயமாக தேஜ்பாலை காப்பாற்ற நினைக்கிறார் என்பது தெரிகிறது. ஆனால், “பத்திரிகையின் நிர்வாக ஆசிரியர், பாதிக்கப்பட்டதாக கூறப்படும் பெண், தருண் தேஜ்பால் மன்னிப்பு கேட்க வேண்டும் என மட்டும் தான் கோரியுள்ளார். தருணும் மன்னிப்பு கேட்டுள்ளார். எனவே, இதில் வேறு பிரச்னைக்கு தேவையில்லை என கூறியுள்ளார். ஆனால், இது சட்டப்பூர்வமான வழக்கு அல்ல. இப்பிரச்சனையை அலுவலக மட்டத்தில் தீர்த்துகொள்ள முடிவெடுத்தோம்; இந்த வழக்கை அந்த பெண் தொடர்ந்திருக்கவில்லை”, என்றும் செய்தி ஆசிரியர் சோமா சவுத்ரி கூறியுள்ளார்[7]. அதற்கும், பல தரப்பினர் கண்டனம் தெரிவித்து வருகின்றனர்.
